    Rejected my claim for £1440, even though this was virtually every month over about 2 years.

    Now taken the next step and hope the FO help.

    How are you arguing your case to the FOS? You have to make the FOS that you disagree with their decision based on what they sent to you. If you simply write to the FOS saying you disagree with the bank then you need to say why and not just that you disagree with it.

    Thanks for the advice. I highlighted I was in a cycle of charges every month and this also led to me defaulting on my hsbc cc at the time. I hope I pointed out enough information.

    I hope you reclaimed the charges on the Credit Card account ;)

  • i originally started out with 2 claims both with natwest , one i sent in a couple of weeks before the other , to cut a long story short i received a payment on one of the accounts and called natwest to find out about the other one , they advised me that i would be receiving a letter with the offer in a few days and told me the exact amount i would be getting back , 2 days later and the court case was announced so my reclaim was put on hold !! i called natwest and they told me that there wasnt any record of them making me an offer and as i hadnt anything in writing i would have to wait for the outcome of the case , now after the court ruling they sent me a letter saying that obviously i wouldnt be getting a penny back . I used them template letter on here to state how i was treated unfairly but i have recieved a reply denying that they ever made an offer and that still they would not refund my charges- i called them and they told me that as there was no record of the conversation i had where the offer was made then unfortunately it was tough luck .. can anyone advise me of what i should do next

    Did you take the name of the person you spoke to and the date of the phone call?

  • yes i have it written down somewhere , i just have to find it , though when i told them this onfo before they still denied that the conversation ever took place , this was going back to when i called them just after the court case was announced

    Wrote a letter to Halifax as per the template letter and mentioned hardship . Halifax refusing to pay out any money for Bank charges . So followed the advise on here and sent them a second letter more detailed and their reply - not budging !
    Anyone else having same situation with Halifax !!
  • After sending another letter and filing out a form explaining my personal financial problems and asking if they could consider my case because since my intital claim letter back in 2008 I have had further charges! They have basically said NO! I threatened to leave them and empty my savings account but they didnt budge, After going down the financial hardship route they offered very little sympathy and referred me to a financial advisor!!! They are obviously trying every single trick in the book but I am getting no where! Can I now threaten them with court action, would this help them to pay out??? Or should I just give up. I thought they might offer me somethign as a good will gesture!

    Please advise anyone out there.
    P.S. If I dont respond to therie lates letter within 8 weeks my case will be closed.

    Danny, do you have priority debt arrears(mortgage,rent, council tax, utilities)?
    Are you expecting 100% refund of charges if you are in financial hardship because that is not how financial hardship claims work. There is no 100% refund, there may not even be 1% refund and the bank would still be within their rights not to refund anything if they offered either an extension to an overdraft, or even waiving charges for a period of three months.
