    What argument were you using with the FOS?
    What reason did you ask that they overturn the banks' decision?

    I was being charged on charges and stuck in a cycle of charges. On one occasion I was charged £79.50 for going £2 overdrawn (£25.00 for the First Day Overdrawn, £25 for the 5th Day Overdrawn and a £29.50 Failed DD Charge)

    Why or perhaps the question should be HOW are you disputing the banks initial decision to decline it?

  • I have been reclaiming from for charges dated March 2001, waited through the whole court case etc. Re sent new claim for hardship. Bank charges total £7492.50. The bank has made me an offer of £1124.00, they say in letter that they appreciate my financial hardship but that I left insufficicent funds in my account as i took funds via ATM. They go on to say my account indicates items of expenditure that they consider to be non essessential in nature. They go on to say that they however believe that the bank could have taken earlier action and cancelled my direct debits that were unpaid and that if they cancelled the direct debits this could have reduced the level of charges incurred and that I should change my account to a basic account rather than a current account on accepting the offer.

    Dont know what to do next. should i ring the bank????? or go to the ombudsman. Accept the offer and be greatful for reciving some of my money back.

    Help really appreciated. Only have 14-days to accept offer.
  • hi all, i've been trying to get charges back from TSB since 2007, at beginning of this year i received a letter telling me they dont have to pay because the courts ruled in thier favour. I contacted the Ombudsman service who contacted the bank, i received another letter from the bank saying they still wont pay me back, i've written back to the Ombusman service so fingers crossed they will keep on top of it, i'm not giving up until i have MY money back.
  • perhaps mine is different my account was £4079 over drawn in charges
    hi claimed £4079 got £4079 well they quoted the test case and said they were entitled, to charge. then said as goodwill they closed my account and i had nothing to pay them.
    i went through hell with them they sent bailifs before the test case and banged on my door. i told him the total was for charges and he said really ive claimed mine back also! the balifs wrote to me and said they had closed the file and sent it back to nat west.
    then after the test case results it started again with balifs and scolicitors letters
    so i wrote a stern letter to nat west saying take me to court i was never going to pay the charges. i won :j:j:j:jgood riddance NATWEST
  • I tried to reclaim bank charges from the Halifax and even though I claimed financial hardship and filled in financial details they still refused to pay anything out. I also went to the Ombudsman and they basically said there was no point continuing once the supreme court decided they were fair. I can honestly say the Halifax have been the most unhelpful bank i have ever come across

    Reading the forum has filled me with some hope. My bank is Barclays and i have known of others struggling to get anything out of them - out of a stone - blood - make a sentence!

    I'm going to give it a go on the basis that i have nothing to loose and am facing financial hardship. Im pretty sure i went through a 2 year phase of going over my overdraft at least once a month every month, so we'll see.

    Going over the overdraft once a month is NOT financial hardship. Please read my signature which explains what financial hardship is especially page 20 onwards of the Lending Code.

  • Hi, I have tried to claim £2,700 stating I was in financial hardship when I got the majority of my charges £ 1,488 in 1 yr due to my boyf being off work for along time with his disability and not being able to manage on my wage alone. They have sent me a form to fill in (for my now ingoing’s & outgoings) and not then! But basically they told me on the phone they will not pay out. I don't know weather to fill in the form (as I am not in financial hardship at present) or go to the ombudsman.

    Can anyone please give me some advice, I am at the end of my tether and I am starting mat leave soon so could really do with the money!!

    Fill in the form but include a letter with regards to what you were incurring charges for, what priority debt arrears you had, and explain what the bank did when you approached them for help(I am assuming you did).

    EDIT: I would also start to review your current financial position and cancel ALL non essential direct debits/ standing orders if you are going on Mat leave soon.
