UPDATE: Four days later i heard back from Lloyds:embarasse  Jesus!!! They cheeky things REJECTED my claim for hardship. I called the FOS the same day, having explained my circumstances to them they werent very happy Lloyds hadnt even made me an OFFER. they took my details and swiftly sent me a form to complete, which i did.

They say they will review my claim within 10-14days.....:T lets just see what happens:eek:

ONCE AGAIN fingers crossed and will keep u all informed:)

Look forward to hear what happens, as in exactly same position as you with Lloyds, having stated my claim in 07, claimed hardship last year & ignored, have sent letter claiming hardship again couple of days ago! It would change our lives to get a result and be able to pay our priority arrears etc! fingers/toes/everything crossed for us all!
  • Bank: Lloyds TSB
    Amount sought: £43
    Amount offered: £30
    Duration of claim: Feb 2010

Back in 2004 when I was a student and had £100 in the bank, Lloyds took £30 out of my account for a DD I couldn't pay. To add insult to injury they took the £30 charge on my birthday. After reading about bank charges on this site i decided to give it a go - not expecting Lloyds to give a hoot. I sent the template letter and within a week Lloyds sent me a letter to say they were reviewing the claim. Two weeks later I got another letter saying they would pay £30 into my account (I did ask for £43 to cover 6 years interest) but what the hey - that's £30 I didn't have before. I used the 'please give me my money as a gesture of goodwill and for my continued custom' route - and it worked a treat.

    This site is great.

what form is it the OFS sent you?
  • Hi reclaimers

I've just moved a lot of posts from this thread into the general discussion (http://forums.moneysavingexpert.com/showthread.html?t=2248345) as they weren't about successes or failures.

Please post in the general thread if you have a question or comment so that we can keep the success stories more visable to encourage others to claim :)

    Thanks, Wendy

 The OFS send you a form to sign and send back with any additional info. You should ring them first, as they complete the form for you. Good luck and keep us updated
  • Hi.
I need some advice from all my fellow bank charge claimants.....

I tried, first of all to claim my charges back thru the official route, well before the test case put things on hold. I believe from this site they had a certain amount of time to send out statements, but they doubled this time, it literally took them about 3 months to get them out to me... By this time, all claims had been put on hold until the test case was heard. :(

So then i waited patiently, until the ruling was given that the scumbag banks didnt have to repay charges.
I then tried going down the financial hardship route, as I'm currently in financial hardship, and am in debt management plans with my creditors, paying a reduced payment on my debt.

The good old Yorkshire bank then looked at my case, and ruled that there is "No Proof" that i was in financial hardship at the time that i accrued the charges. I must admit, back then it was more a case of not been able to manage my money properly. Since then, i have gone into financial hardship, does this mean that they HAVE to pay me back, or is it a case of i have to prove i was in financial hardship at the time the charges acrrued??

Any help would be greatly appreciated.

    Cheers People.

  • I put in a claim for financial hardship to Ulster Bank (RBS) for £4000 and got a letter back today offering me £2310 as a good will gesture needles to say I accpeted it and am very very happy with the outcome. :j:j:j:j
  • Fantastic...used the template regarding my financial hardship to both Halifax and Abbey to reclaim bank charges. With Halifax they couged up straight away no quibbles - gave back the £1200 claimed. However, Abbey were more difficult, I had to write a further letter after flat refusal on my first letter. I originally claimed for £1600, but they just deposited back into my account today £740. But, I am delighted and really want to say to all in the same situation PLEASE don't give up - keep on at them and they will repay you. Why shoud we be in a worse situation because of these fat cats taking our money!! I am emigrating to NZ end of year and sooo happy that I managed to get some money back..good luck and keep going using the templates on this site..Thank you Martin and everyone on the site x
  • Hi, I thought I'd share one of my smaller successes with you all; (see the PPI thread for the big ones;))
    Bank: Barclays
    Amount: £400 (including Reserve Fees)
Claimed for my niece using the 1st letter template under the hardship rules. I claimed for all of the Reserve Fees and also the unauthorised overdraft fees. Barclays point blank refused the Reserve Fees but offered us full refund on the overdraft fees (£200).
We've now cancelled the so called "Reserve" on the account - absolute waste of space this is - and have just got an overdraft on the account that is used first before any "Reserve"
Partial result but £200 to her is an absolute fortune so very pleased for her :j
I don't post a lot but when I do, I try to be helpful:)
