Hi all, just to update. After over 2 years my fight is finally at an end. I have had a resounding NO on refund of charges from the FOS. To be fair I have to say that the FOS have been brilliant and that their hands really are tied. LLoyds TSB have touched every point necessary of the banking code to cover their own backsides. Ultimately, what it boils down to is, that unless they break the code OR you happen upon a sympathetic bank, you have zero chance of getting your money back. I would still recommend though that people pursue their banks on the offchance, as although only a handful it would seem are getting any money back, there are still some success stories filtering through. Mine is sadly not one of those and my fight is over. But for everyone else, keep at it. You never know. The next success story posted might be yours!0 -

I have been through the hardship paperwork with natwest and paid over £800.00 in charges, they took my bank card from me and sent me a bassic one and offered me £5.00 which i have declined.0

Hi everyone, new to this site - great site!! I would like to ask natweststaffmember a question if that's ok?! I have done all the templates etc to the Halifax regarding bank charges of £1116, which has now come back rejected, however, I am in a debt management plan since 2004/05 and even though I am no longer getting bank charges (obviously the DMP has sort of helped me) would it be worth the bother in taking my case to the FO? The letter from the halifax said that they would get a member of their money management team to ring me in which they did last sat, but even the guy on the phone was surprised as there was nothing he could do as I have no outstanding debt with the halifax but with other creditors!!!!
bit confused! would love it if you could help me understand! thanks!0 -

I NEED HELP!!!
This has been going on for 8 months now, i used all the letters did everything i was surposed to do and of course Natwest turned the claim down even though i had got a letter from Natwest saying that i was counted as being in Financial hardship, i went to the Financial Ombudsman and they have been useless!!
I sent letters recorded delivery and they lost them, iv been calling and emailing but they just dont seem to care, then finaly (after 2 months of unanswered calls) i get a letter saying Natwest has offered me £108 and they think that this is a reasonable.
When i looked at my account the amount of charges that has been added onto my account since i have made the claim is £108! so really they have not offered me a refund, they are only prepared to refund the charges since the claim has been made, when i called Financial Ombudsman and informed them of this they just said that this was a good offer and that i should take it, but its not a good offer at all!!
I dont know what to do now, im at my whits end!
Any advise would be welcome!0 -

Difficulty you have is arguing that the charges incurred in 2004 time contributed to the hardship. I think you need to read the legal argument guide to reclaiming because I think the Bank account is not a goer(any credit card charges though?)0 -

Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
Read the bit under the post with the link on which is about the lending code. Remember the bank does not have to offer 100% of the charges even if you are in financial hardship. Please read all of the Lending code section 9 a few times cos even I get surprised on stuff with it.0
