    So AA going from the UK to New York would be classed as an EU air carrier bot not on the return journey?:(

    No, AA are not an EU air carrier and would not be classed as such.
    EU regulation EC 261:2004 applies to all air carriers departing an EU member state viz recital 4.

    So we booked a holiday with British Airways to NY,they codeshare with AA so we are not covered for flight delays?sorry to ask so many questions,we have never had to claim for a flight delay so far ( and hope not to in the future ).

    Leaving the EU on an AA plane you get protection.

    Returning, you don't.
