Sainsbury's complaint

Hello all,
Sorry if I am in the wrong section but this is my first post.
My wife bought me a laptop from Sainsbury’s on 6th of October as my Christmas gift. She had asked if it included Microsoft office and was told yes. Today I tried to use it but found it only to be a trial product. Now Sainsbury’s are claiming I can not have the word, or return the product as it is out of the trial period they claim of 28 days from purchase. Even though was Christmas gift and not opened until Christmas day.
Have seen on Martins tips this.... “· Goods should be of satisfactory quality and as described.
The Sale of Goods Act 1979 ensures goods should be of satisfactory quality and fit to do the job intended for them. Fit for purpose means both generally e.g. hi-fi speakers should play music but also specifically for any purpose you've asked. E.g. if you've asked ‘will they fit my Hitachi Hi-fi?', and been told yes, but it doesn't then it wasn't fit for the purpose specified. “And would guess this would be true in this case.
I knew she was looking to buy me one so I had told her I wanted and what she had to check for including RAM and Hard drive size and software included. When told so and so laptop is the one you want.
Please help as their local shop passes me to customer care help line who say my complaint is with Compaq not them and refuse to help in any way at all. What should I do next?

I had cause to do so recently and received a written reply within about two weeks - the decision agreed with me and disagreed with what the customer care line said and i also received some compensation as a result.0 -
Most PCs come with a trial MS Office, when you first used the PC, you accepted these terms and conditions.
I doubt you have a case. I suggest you use Open Office instead, which is free to home users

Freddie_Snowbits It is some time since we bought a new computer and our desktop did come with office installed. and I have on a couple of times had to reboot it to factory settings and it still has has full office on it. The point here is My wife was sold the laptop on the basis that it WAS included, thus making it not fit for purpose specified by sales woman0 -
technically it was included, the trial (for the all singing/dancing version) lasts for 3 months whereby they hope you'll buy the licence for said version, the compatibility version that is left if you do not is perfectly adequate for most users needs.In spite of the cost of living, it’s still popular :eek:0

I would be grateful if you would enlighten us all as to where these PCs could be purchased, as I have never had one that has MS Office preinstalled.0 -
Are you sure it wasn't just Word that was included on your previous PC this did used to come included in the Works Suite a few years ago (which was popular to come preinstalled on new computers) until they scrapped it and replaced it with just Microsoft Works.
It is very unusual to get a computer with office preinstalled unless it was custom configured from an online retailer. Sometimes there maybe offers where they included a boxed version of the product for free or a discount but this wouldn't be pre-installed.0 -

FWIW, I purchased a Medion desktop from PC World a few years ago which (admittedly, to my complete surprise) had a full, non-trial, install of MS Office. Moreover, it was also pre-loaded with XP Pro, even though the spec stated XP Home; and the box was factory sealed. So I have no doubt it can happen.
In any event, the key to this issue relates to any representations made by the salesperson to the OP's wife as to the spec of the purchased laptop.0 -
We bought the Desktop from Staples on our business account and it was preinstalled and we got the disc with it but this is MS office 2003 and has excel etc too. this is why we asked if this was also included with the new laptop but as we have not upgraded for 5 or so years we did not know anything had changed and took the sales womans advice.... or my wife did.
ToZer, whats wrong with being organised for Christmas.0
