  • Regardless of who is right or wrong here the comments about the OP caring about a bargain than the safety of her child are completely out of line. I find it hard to take anything else said by that person seriously tbh. There's simply no reason to make this personal.

    On the whole I would say that I am critical of eBay/Paypal. I cannot think however, what more eBay could do. Before you had this bad experience do you think that you would have read/follow eBay guidelines on cash on collection transactions? While there may have been reasons for the condition of the item not apparent at the time I think that eBay could reasonably say that you had the opportunity to inspect the item.

    The seller should not have sold am item but from the sounds of it there were perhaps things that should have sent alarm bells ringing. I have been ripped off and it is not a nice experience but I have learnt. Now I check things over more carefully. In the past I have felt awkard about doing this but now I just say that I have had a bad experience in the past. Most are ok with this. Some can be a bit stroppy but I just take no notice.

    I recently brought a dodgy vacuum from a carboot. I have to take
    responsibility for this. I thought that I had checked it over. I was annoyed but I did not think that the sale of electric items should be banned, after all many people are more than happy with their purchases.

    I thought that perhaps you were just a bit wound up but it does seem like it is more than that. I thought that perhaps when you had calmed down you might realise that COC on the whole works. We constantly take risks and most of the time things work out. I do not think that taking away choice or adding rules in this case would be beneficial.

    I think that most people here are not trying to be unkind. I can see why you would take some comments personally but on the whole people are only putting their point of view across.

    Unfortunately OP it is Caveat Emptor and it is your responsibility to check any item throughly. If you are not qualified to do so then you should have somebody available to check it out before parting with your cash.

    Thsi really has very little to do with EBay and should be treated exactly the same way as any seconhand purchase from a private seller.

    The seller could argue that it was fine when you bought it and was subsequently damaged, by you.

    You aren't going to change hundreds of years of legal precedent that has stood the test of time.

    You made a mistake and quite naturally are very angry with yourself. Doubt you will make the same mistake again.
