    If you buy something from a private individual regardless of payment method it must be 'buyer beware' it is your responsibility to ensure that goods are what you were expecting. It makes no difference with this whether it was ebay or small ads or from a bloke in a pub, you accepted the goods as seen.

    Yes paypal might have helped, although actually I doubt it in this case as you would still only have been able to do a significantly not as described claim, and as soon as seller stated you had seen and inspected the goods and had accepted them I fear you would have lost that as well.

    Your not actually listening to people you yourself said you didn't check the item. you didn't even wheel it around the room. Its like your trying to push the responsibility on ebay or anybody else for your own failings.

    Most people if something like this has happened would think. OK I made a mistake I'll learn from this and get on with my life. All you seem to want to do is blame others. You really need to take a long hard look at yourself and think about taking responsibility for your own actions.

    I apologise if it seems a bit harsh but all you have seemed to have acheived is to make yourself look rather silly and unwilling to take responsibility for yourself or your actions

    What you did is just the same as buying something in the classifieds or free news papers - Im suprised the OP doesnt just give you your money back the risk of bad feedback on eB would surely persuade the seller ?

    I'm guessing that since this has gone through the small claims court, that the feedback period has long since passed. Besides, the seller seems to have earned £100 for selling some old tat, that's probably a decent price for a neg these days!

    This will be the thread that never dies - It's now just a rather bitter woman trying to blame someone/anybody else for her own mistakes, and trying to deny any sort of responsibility for not checking the pram or car seat properly in the first place. no matter anybody says, it will be the wrong answer.

    Would think it would also depend on what the item listing said, ie good condition or used sold as seen.

    Anything I sell on ebay that is 2nd hand goes under the 'used sold as seen' title.

    As has been said its buyer beware.

    As for the original question, no COC should not be banned on ebay, the majority of the business i do on there is COC (agri machinery), if its not up to scratch when I go to collect I try and renegotiate or walk away, whih I have done and still have a 100% record on there.

    OK, I give up! You still aren't reading posts correctly. Here's my final say:

    You are right.

    I am wrong.
    Others posting here are also wrong.
    Ebay is to blame.
    Paypal is to blame.
    The Small Claims Court is to blame.
    The Judge is to blame.
    The seller is to blame.
    COC should be banned... but you are right! (have I said that already?)

    ... and the Government should provide you with a responsible adult to help you with your future purchases. That way, if it goes wrong again, it won't be your fault (a bit like this time!). ;)

    Of course you've got 100%, buyers can't get negged anymore. :p
