Purchased an empty DSI Box from ASDA for £147.71

I purchased what I thought was a Nintendo DSI from ASDA on 22/12/09 for my 10yr old sons christmas present. I took it home wrapped it up & my son opened the present on Christmas Day to discover to our horror and dismay there was no DSI in it. There was only the charger the stylus and the instructions in the box. Needless to say he was utterly distraught and inconsolable. Christmas has been ruined by this whole affair. I returned to the store today 27/12/09 which is the first open day since Christmas Day. The store are unwilling to start investigating the matter until tuesday & refused to give me the product I paid for. Help what can I do?

    was the box sealed? did you have to collect the item from customer services or something? if it was opened did you not check before hand?

    why are they refusing to investigate what reasons have they given ?
    was it the same one you bought it from and did you have the recipet etc? did you speak to any manangment?

    I would guess that the sales adviser that sold it to you isn't in work and they want to check the facts with them before doing anything. They can't just give you a new DS as you could be committing fraud by making the whole thing up.

    A very interesting scenario. Strictly speaking you should have (or they should have) opened the box in front of you to show you the item was in fact in the box. This is what most supermarkets do with expensive items such as mobiles etc.

    They may well be waiting for the electronics dept. manager to come back on Tuesday, to check what might have happened to the item. If it was any other store, without the excellent reputation of Asda, I'd say you were up the river without a paddle. But somehow I think Asda will come to the rescue. Legally I don't think you have a leg to stand on.

    I can smell a bit of a troll too. But I'll be honest with you. If for whatever reason I was sold an empty box, I would make sure that I received my item. Whatever way!!!

  • People have bought laptops before now and received concrete bricks...

    AND... The stores know PRECISELY how much the boxes weigh, since the introduction of the Self-Scan tills..............

    Most stores will NOT allow you to check the boxes at the time of paying. Try it... See what happens...

    Asda should have checked. If I was Asda then I'd check the weight of high value items, simply because I had the ability to do so.

    Don't rate Asda much anyway.
