Hi all,
I wanted to share my experience about the above after spending 2-3 hours today trying to get this sorted.. I need to feel like I have accomplished something from today!
I realised this was a scam today when I notice that £58.51 had been withdrawn from my account under the name MLN*EVERBRITWHITS.COM
I already had a small amount withdrawn for the trial tooth whitening kit which was the only payment that I expected. So to cut a long story short, I first rang the bank who are sending me a dispute form. (I am not really convinced that I will get the money back but we will see!).
I then spent a couple of hours trying to get through to the number (00) 1-877-666-0531 which was given to me on my trial order confirmation email. I wouldn't waste your time trying some english numbers that are on here as I found they all diverted you to the USA and I even rang one which was a similar but different company therefore wasting even more of my time (this number is for EVER BRITE WHITE!).
When I eventually got through I told the sales woman I wanted my account with them terminated straight away. I then received an email from donotreply@donotreply.com (surprise surprise). On here there was the link: http:// www. xmorders. com /mc (spaces in the address as I can not paste a link).
Apparently you need to fill this in and press submit to cancel your 'subscription'. Irritatingly my details would not work but after ringing up AGAIN I was told to enter my details using lowercase letters for your zipcode (postcode) and no space. The password I used was 'online' and the signature is your first and last name all lowercase with no space between them. For your telephone number you need to remove the '0' at the beginning.
I was also told on the phone that to get a refund I need to post the product back to them at the following address (I am still waiting for the product but apparently it has been shipped):
3609 North 29th Avenue,
Hollywood, Florida,
Zip: 33021.
On the front of your package you need to include RAM: your order number and the date of cancellation of your 'subscription'.
I hope this helps someone! I am however still awaiting my confirmation email but was told this can take up to 24 hours. If all else fails I now have proof of trying to cancel this 'subscription' to claim my money back with my bank.
Good luck!!0 -
Anyone who has been scammed by these thieves should fill in the online form provided by the Florida Attorney General who is investigating them (takes less than 5 minutes to fill in and press send). Keep a copy (word doc, text file, email) of what you send as the Florida legal team investigators will send you a paper form to fill in, sign and return to them. It is optional wether you do this but it will help the Florida authorities to build a case against these thieves and hopefully force them to pay back the money they stole.
XM Brands (Everbright Smiles) are based in Florida and the Florida Attorney General is currently investigating them: http://www.myfloridalegal.com/lit_ec.nsf/investigations/E2B4046B28E10B148525768C005B8E6C
I am sure the investigators in Florida would find it very helpful to hear from anyone who has been scammed:
Economic Crimes Division
Office of the Attorney General
1515 N. Flagler Drive, Suite 900
West Palm Beach, Florida USA 33401
Telephone: 00 1 561-837-5000
Or you can use the online form here:
http://myfloridalegal.com/Contact.nsf/Contact?OpenForm&Section=Economic_Crimes
(Fill it in (takes 5 minutes) then scroll down and click submit)
That way your name will also be on the list for refunds if the Florida Attorney General orders them to refund the people they ripped off (which has happened with other companies in the past, eg: Acai)
If you can remember the website which led you to the scam (probably a fake news site or fake blog: eg single mom teeth whitening trick) then give that info to the Florida Attorney General too as they are trying to track down the people who are putting up the fake blogs/news sites and ads which are affiliate sites promoting this scam - for example one of the sites/people promoting this scam is:

EVERBRITES HAVE NOT CEASED TRADING as long as they continue to remove funds from accounts even after attempts to cancel and claim backs from the banks involved!
My bank has been very good, refunding to my account and advised that every claim back like that costs EVERBRITES money – maybe that is why after the second payment was stolen on 13th April they took another one less than a week later on the 19th! NB one of the payments was taken by a different company name “IBUILDWEALTH” but my bank were able to identify the funds were going into the same account.
Make sure you check you bank statements for ANY unidentified withdrawals!
I have now cancelled the card I used to make the initial payment and wish I had done this immediately after the first withdrawal was made! Don’t waste time waiting to see if it will resolve itself – they just steal more money!0 -

Indeed and as this confirms all the scammers do is change the name and the scam continues:

Everbrite = Alpine White = Ibuildwealth etc - same scam, different name. They also make the charges under various names in the hope that it won't be traced back to them or recognised as them by the victim."The happiest of people don't necessarily have the

Hi, i would just like to post a quick update on my progress on the subject. Well i first discovered 7 days ago that i had been scammed by these. I firstly, contacted my bank and got my card blocked and explained the situation to them and they said that they would investigate. I have now had a refund and a letter from the bank apologising for being a victim of fraud. They are sending me a form out to fill and sign and hopefully this is the end of the matter. I did get the product sent to me today, but with no forwarding address what so ever to post it back!! So pleased i got my money back and they should no longer be able to take any more from me....0

Please help me shake off these fraudsters and let me know who you bank with.My building society are not helping me very much and money is being drained weekly and need help0
-
I think every one has a right to ask for their card to be blocked for what ever reason. Try Santander (Abbey).......0

Just ask them to block the card they have no right to refuse this request. or report it lost/stolen this blocks the card anyway.
Good luck0 -
Going through same process now - my bank told me to not to cancel card!! - worried sick!!andywinchester wrote: »My bank has stated DON'T try different numbers to cancel your order the only number you should call to cancel payments is the number you have on your ORDER COMPLETED, emailed to you, the one with your reference order number on it.
It states if you have any questions regarding your order call us at:
The current number is 001 888 694 9257
By law this is the number the company has given you to contact them!
If this number is unavailable "which it is so you cant cancel" this is classed as "OBSTRUCTION" by a court or a bank.
If possible have some one with you when you call to verify you have called to cancel, keep a record of the number, and the time and date you called.
1: Write a letter confirming you wish to cancel your subscription, Also include a copy of your order details sent to you by Everbright, send it to the current address given on the terms and conditions for Everbright. SEND THIS BY REGISTERED POST
this is proof for the bank that you have attempted to cancel.
2: Also email this letter confirming your cancellation to care@everbrightsmiles.com This email is correct on 1/4/2010
*Then call your bank and report your card lost or stolen, this immediately blocks the card from use by any company or individual around the world.it also stops the inconvenience of having to start a new account if you close your account. N.B you should get a new card within two days so it's not to inconvenient."I got mine the next day"
All this should be done immediately after you have ordered if you suspect something is not right.
or as soon as possible after money has been taken from your account.
This is to stop any company be it Ever Bright or any company associated with them, from taking further payments from you're account and for the bank to have confirmation that you have attempted to cancel but have been obstructed from doing so!
the bank will then send you some forms to fill in, they will then wait 30 days to see if the product arrives, if it does at least you've got something for your money !!!!
They will then contact the company to inform them that you as a customer have been obstructed from canceling any further payments to their company, And that this is contrary to their terms and conditions of sale.
They will then also attempt to get any monies taken, reimbursed."though I must say this is probably unlikely to happen"
Apart from this you probably haven't received any product anyway so this will be used by the bank also.
The important thing is DON'T PANIC These companies want you to do that!, They can get more money out of you by sending you on wild goose chases by phoning different numbers etc
Once you know no more money can be taken from your account, believe me you feel a lot better.
Hope this helps.if i had known then what i know now0 -
Foolishly I sent off my order 'free trial' 20th april and immediately realised I'd been stupid. To date, never received anything, i.e. confirmation, goods - nothing - don't even know if I've got a confirmation number on the printout I received from bank(tsb) today were they've taken £2.61 + £1 currency charge. What worries me now is,: bank said I've got to keep checking for if/when they take out a payment, then I must cotact them again (the bank) and they willget my money back (even though I've taken out every penny) by the way, they told me not to cancel my card!!!Another problem is, someone on forum said the banks will send a form to fill in but also send a copy of e-mail sent cancelling order - 1st one I sent was on a 'form' with everbrite to cancel subscription, I filled it in, sent 'submit' but that's all, I've got no proof that I cancelled, other than an email address I found on the forum - worried sick!!I've got no proof of confirmation order or anyuthing!! except that I sent it via my bank card.PLEASE can anyone stop me from these sleepless nights???
I'm getting old now and I know I've been so stupid.Even th banks seem to make you feel 'well, it's your own stupid fault' !!andywinchester wrote: »Everbright smiles appear to have ceased trading according to my bank. 31 MARCH 2010
Have checked and There doesn't appear to be any site's now with the Everbright name,
Also there are no Internet links from other sites as these are now broken. the only entry I can find is their terms and conditions page
"NOT SURE IF THIS IS GOOD NEWS OR BAD" for it's customers "victims"
No doubt they will start trading under a new name
1/04/2010 Have managed to log on to everbright today, they have changed the adverts appearance and they also appear to have changed the wording on the terms and conditions.if i had known then what i know now0
