    I have been away for a few days, thought I would have internet access ( but didn't ).
    Have just read the last few posts and am now really !!!!ed off.

    It's ok, hope you had a good break.
    Esmerellda, I have yet to get the exact figure from Tim, I called him Fri PM to let him know that the money had not gone in at 2PM (as promised a 2nd time) and to ask for an exact figure, he didn't answer his mobile so I left him a voice mail, u tried to call back again about ten mins later and his mobile was switched off. RH have also stopped answering their phone after about 345pm.

  • I phoned Robertson Holbrook this morning and (eventually) spoke to Tim Russell who said he'd look into it and call me back this afternoon - I'll not hold my breath on that one!

    I also phoned Capital One - only had the general number - asked for Rachel Howey and was told she doesn't accept calls direct, so I'm stuck!

    Will update you if pigs fly and Tim calls me back!

    Tim is apparantly in Court this morning but has promised to call me back this afternoon in connection with both Yan and Gill's claims.

    I have also been in touch with Rachel Howey this morning, she left Capital One's employment at the end of December but I have asked her for alternative contacts at Capital One and also for her advice regarding these outstanding Robertson Holbrook claims.

    I am pretty sure that Capital One have no idea whatsoever that monies they are paying out in settlement of Customer's claims are not being paid by Robertson Holbrook. I therefore intend to pursue a course of action with Capital One with a view to suggesting they cease to deal with Customer claims presented via Robertson Holbrook.

    In both Yan's and Gill's cases I suggest that Robertson Holbrook are pursued for the FULL amount of the refund provided to them by Capital One. Normally Robertson Holbrook would retain any 'interest' payment received from Capital One, over and above the actual amount of charges being reclaimed, as their fee for handling the claim on behalf of the Customer. Most Claimants would perhaps be under the impression that the fee being retained by Robertson Holbrook would probably only be around 8% or so of the charges total. However, it is clear that this is not the case. Capital One normally refund ALL purchase interest ever paid by the Customer when refunding charges and depending on the usage level on the card this 'purchase interest' amount can be quite substantial. In some case it can actually be more that the charges that are being reclaimed. In addition Capital One normally refund a straight 8% interest on the charges they are refunding. Capital One calculate refunds in this manner so as to potentially confuse the interest issue when / if it is argued as part of a county court claim for compound interest.

    It is clear in both these cases and sadly I suspect that there may be many many more like this, that Robertson Holbrook have not provided the service that a Customer might reasonably have expected when entering into the contract.

    Once again, I must remind any potential new Claimants reading this thread.
    There is absolutely no need to use a Claims Management Company such as Robertson Holbrook when reclaiming your credit card charges.
    There are many free to join and use Consumer websites that will assist you in performing this extremely simple process and not charge you a penny for doing so.
    I can normally be found on the Consumer site www.legalbeagles.info and would be pleased to assist anyone with a new claim on either that website or on MSE.

    Update

    Wendy Starr is out until tomorrow so I spoke with Adam Berman in the Legal Dept.

    This is not usually Adam's area but he was extremely concerned that Capital One Clients have not received settlements that they may have been expecting to receive from Robertson Holbrook, especially so if those payments have actually been made to Robertson Holbrook by Capital One.

    He asked if I could provide him with the names, account details of the claimants in question. I said that I would seek your permission ( Yan and Gills ) before doing so. If you are happy for me to act as an intemediator in this matter then please could you both PM me with your names and Capital One account numbers. I said that I would give Adam a call back later this afternoon.

    Adam has gone away to discuss this matter with the Department Head and to review all outstanding claims with Robertson Holbrook and to assess the overall risk. He will also be ensuring that someone from Capital One talk to Robertson Holbrook this afternoon.

    I suggested to Adam that it may be advisable for Capital One to discontinue the practice of making settlements via Robertson Holbrook for any outstanding claims. It would be safer to refund the Customer and then suggest that the Customer makes their own individual settlement with Robertson Holbrook for work carried out in handling the claim.

    After speaking with Gills earlier this afternoon I spoke again with Adam Berman at Capital One.

    He is looking into the specific situations for both Yan and Gill's claims and additionally investigating all other recently closed and currently open claims placed via Robertson Holbrook and checking to see if there have been any similar complaints. Adam is actually the Para Legal responsible for handling unenforcable CCA claims against Capital One but has agreed to be the point of contact regarding this issue until it becomes clear how the matter can be resolved. Usual contacts on the charges reclaim side at Capital One are Wendy Starr, Lisa Walker and Zed Padgett ( a new Lady ). Rachel Howey left at the end of December to commence a new postition elsewhere.

    Adam said that he should be able to get back to me by tomorrow PM with some news. They are quite shortstaffed in the office today owing to transport / weather problems.

    I am still awaiting a return call from Tim at Robertson Holbrook.

    I received a call from Tim this afternoon - he started by saying they still haven't received anything from Capital One blah blah blah! I stopped him and said before you tell me any more mistruths, Capital One confirmed today they settled this back in August last year!!

    He said he'd need to check with their solicitors and will speak to me again tomorrow. I said to him - don't make promises you can't keep! He reassured me he will contact me in the morning - I will update as soon as I speak to him again.

    He's feeding you the same bull he fed me only I was daft enough to listen and believe him for far too long and if it wasn't for Budgie and Esmerellda and everybody else on here I would still have been fed crap by him!
