I've been trying to call Tim today but RH's answer phone is on so I couldn't get through and I don't have Tims number.
Tim said that I hadn't received my money from the bank transfer made befor Christmas as 'somebody' had tried to transfer millions instead of hundreds...:rolleyes: and that he would set up a transfer on Monday...still waiting

Ok, have told Budgie, he'll be giving Tim a mouthful I suspect shortly. Shall we draft a Letter before Action then and prepare to take them to small claims for return of this money. I really would do this asap as they are under strike off proposal again at companies house and you don't want it lost in some creditors meeting.LegalBeagles0

I spoke to tim this morning who said I would have my money by 2pm today as the BACs was made on Mon pm.
I still haven't received anything! I'm going to try him again in a hour.

I have passed on that info to BigBudgie but that info is rubbish. BACS is 3 days so if it was paid for Tuesday Bacs then you would have had it THIS MORNING. BACS does not work real time as such so if he is trying to say to you that because he transferred it in the afternoon that it will arrive in the afternoon then that is nonsense.0 -

Right, I have checked my bank again and there's no payment. This is the third time I've been promised my money back and not received anything.
I've also called RH who tell me Tim is not in the office, he will be back in half a hour and they will get him to call me, Surprise surprise, I didn't get my call returned. I've been trying to call for the past 45 minutes and all I get is the answer phone.
I could scream, I hope nobody EVER considers using Robertson Holbrook after my experience and Tim is the biggest liar I have ever come across, he should be ashamed of himself. I have never been so angry in my entire life.0 -

Formal Letter before Action
NAME REFERENCE
In XXXXX 2007 I employed your services by form of agreement to act on my behalf in reclaiming unfair credit card charges from my credit card provider Capital One. Following negotiations Capital One made an offer in August 2009 of £XXXXX to be repaid to myself via your company.
Capital One issued the cheque (reference number XXXXXXX) to Robertson Holbrook on XXXDATEXXXX.
The agreement with your company was that you would take your fee of XXXXXX from the payment and forward the balance to myself within XX days (or whatever the contract said or put ' a reasonable timeframe' ). This has not been received.
CONTACT IN BETWEEN AUGUST AND WHEN POSTING ON MSE - just brief details
I have given you a reasonable opportunity to resolve the issue and pass on the payment made to you in respect of my claim against Capital One. You have failed to do so despite assurances that you had made a BACS transfer on 22 December and a CHAPS payment on 04 January which have not materialised.
I have now been left with no alternative but to seek legal redress through the courts.
Unless this matter is satisfactorily resolved within the next 7 days I will instigate legal proceedings without further notice. The cost of this action will be added to my claim.
