    Still nothing from Tim at RH - Not that I expected anything, this guy is a compulsive liar.

    Plus am waiting for call from Adam at Capital One. Will keep trying.

    By all means, both Yan and Gills, should send off an LBA asap.
    Claim figure should be the total figure that Capital One paid across to RH, you both know what these respective figures are for each of your claims. RH are in breach of contract by not passing on settlements to you within 7 days of receipt of same from Capital One. Plus they can hardly be considered to now be providing you with an acceptable standard or level of service.

    I intend to try and work on Capital One to get them to settle your claims directly with each of you and for them to then attempt to claw back the settlement from RH. If they have ongoing 'business' then that would be fairly easy for them to do and I am pretty certain that RH will resolve matters a little quicker with a company such as Capital One on their backs. I doubt whether Capital One will go for it but its well worth a try. Will keep you advised!

    I must have called Tim 5-6 times today on his mobile and called the office. I've left two voicemails and a message with a collegue of his and he's not bothered to return my call the usless *$*@
  • i am dumbfonded by the thread ive just read. i have been tryingto extract a cap one payment fron rob hol since september after discovering that they were paid in july 09. i have the exact same response with excuse after excuse.cap one paid them just under 4000 pounds and i received one payment of 650 pound in error i just dont know what to do

    How many more? This is absolutely terrible and I'm sorry for you as I know how much stress it has caused me and I'm not claiming half as much as you/

    Just what on earth is going on, can't we involve the police or go to the papers? This is surely illegal, this is our money that is obviously being stolen or god knows what else.

    Well the constant calling to Tim and RH by Gills, you, myself and Budgie have done nothing but I don't think we ought to give up calling and pestering the life out of them.

    I don't know what else to suggest other than follow the advice that has been given to me by Esmerellda and Budgie.
    Esmerellda very kindly drafted me a letter to send to RH which I probably would adapt to suit your circumstances and send in to RH ASAP. The letter is further up on this thread somewhere.

    It may be that Budgie will also want to take details of your claim and speak to Adam at Capital One about your claim too.

    We will see what other advice is given on here and I'm sure between us we can decide on a plan of action for you.

    It's strange that all the money that hasn't been paid to us is from Capital One, isn't it?

    I am not at all surprised that we started with one and are now at three people in the same situation. Unfortunatly I suspect there are a lot more to follow.

    Please could you PM me your details ( name and Capital One account number ) and I will pass them onto Adam at Capital One.

    I am escalating this in the morning to the Ministry of Justice and the Office of Fair Trading. I have left a message on Tim ( of RH ) to let him know about this and suggested once again that he call me to at least let us know what, if anything he and RH intend to do to resolve matters.

    PS : Could you also confirm the exact figures. How much Cap One paid to RH? How much you were expecting to receive in respect of your refunded charges and a bit more detail regarding the £650 ( mistake payment )
