I do not understand why you have made a new claim for JSA stating that you are fit for work whilst your original ESA claim, med certs from GP indicate that you are not?
You said that you scored 0 points at your medical, which seems to be an alarming common factor nowadays. That even the most eligible criteria applications for ESA are being awarded similar at these atrocious ATOS examinations. Something is wrong!
If you had appealed the decision and continued providing med certs, like some others have mentioned you would have had your ESA reinstated at the 'assessment phase rate' (basic) from the date of your submission until your Tribunal hearing was decided. The DWP have to do this.
It may seem daunting appealing against the DWP, however a huge number of appeals are successful as the Tribunal are impartial.
If you had won your case then your benefit entitlement would have been backdated from the 14th week of your initial claim and at the main phase rate.
Incidentally, you could not make a new claim for ESA anyway under the same (state of health) conditions for 6 months. Only a new ESA application within that timeframe would be eligible if your health detiorated or under a different health reason.
Perhaps the OP felt that they were fit to return to work? Not everyone wants to live their life on benefits!Gone ... or have I?0 -
I've heard, from an impartial source, that the WCA is perhaps the fairest medical test in the world!!!0

The OP said that he would like to try to get back to work (and all credit to him for taking this step).
But originally OP was ill and claimed ESA which was refused.?
Perhaps bullied into claiming JSA probably without being properly informed of his rights to appeal against his entitlement for ESA?
Why are you so concerned about my posting anyway? It was addressed for the attention of the OP - not you!
Has it rubbed you up the wrong way?
Do you work for the DWP?
...........some other reason?0 -

as i have said previously without going in to detail i had some issues, and yes perhaps i would have continued claiming esa if i had not failed the medical, and yes i am aware of the rate of falure, but me failing this medical gave me a short sharp shock to actually get back into work, when your in a rut you find it difficult to get out of, and in a wierd way this has helped to sort me out, i want to get back into work i used to enjoy my job and i mis the sense of pride i had when i was working.
i also want my kids to look up to me, is this an issue for you?
i am going to sign on tomorrow and when i do i will ask for a form to appeal the esa decision because at the time of the medical i wasnt fit for work, i also think this is my best course of action
i decided that for myself and also with the help of many on this board who have really helped me0 -

Of course it is not an issue for me.
I'm glad that you feel up to looking and facing work and that you get the job that you are looking for. I wish you all the best.
I was only trying to help in the way of advice, in particular ESA that I know a lot about. I'm sorry if I offended you in any way.
