If you can't get any joy with the LA, I would contact your MP. You are entitled to your entitlement prior to the benefit suspension now, not when they have assessed the rest of your claim.
i will ring them on monday, i have had a ring back off the dwp aswell. (rang to make sure they have recieved my jsa5, they havent yet ) she said my claim would be marked as priority, does that sound right, or is she fobbing me off?

i have recieved my letter today explaining that i will recieve job seekers from the 10th november
so i assume that someone else makes a decision on whether i can claim my back dated jsa as its not mentioned in my letter, is that correct??
also im a bit worried that if i dont find a job by february they will stop all my money;
in the letter it states that we cannot pay you jsa from the 4th of february because your entitlement based on class 1 national insurance contributions has ran out, does that mean i wont beable to claim anything by that date??0 -

I am not sure about your first question but it maybe that the backdating is looked at separately.
Once your contribution based JSA has run out you will be able to claim income based JSA assuming you do not exceed the income/capital limits.0 -

I am not sure why they have stated your CB JSA will run out on 4th February, as even with backdating that will not be 26 weeks. I would call and query this date.Gone ... or have I?0 -

Yes but I do not think it is a long procedure, they will write to you before your conts based JSA runs out.

Nope, am sticking to online shopping in future - it was such chaos that we ended up hiding in the John Lewis cafe ... and eating cake!
You'll have to change your claim to IB JSA once your CB JSA runs out, but you don't have to do the whole application again, just a shorter form, plus you need to provide details of your savings etc. You'll still qualify if you have savings under £6,000 and no other income.

I do not understand why you have made a new claim for JSA stating that you are fit for work whilst your original ESA claim, med certs from GP indicate that you are not?
You said that you scored 0 points at your medical, which seems to be an alarming common factor nowadays. That even the most eligible criteria applications for ESA are being awarded similar at these atrocious ATOS examinations. Something is wrong!
If you had appealed the decision and continued providing med certs, like some others have mentioned you would have had your ESA reinstated at the 'assessment phase rate' (basic) from the date of your submission until your Tribunal hearing was decided. The DWP have to do this.
It may seem daunting appealing against the DWP, however a huge number of appeals are successful as the Tribunal are impartial.
If you had won your case then your benefit entitlement would have been backdated from the 14th week of your initial claim and at the main phase rate.
Incidentally, you could not make a new claim for ESA anyway under the same (state of health) conditions for 6 months. Only a new ESA application within that timeframe would be eligible if your health detiorated or under a different health reason.0
