  • depression, im worried now that my housing benefits will stop, i think i might just claim jsa (is that correct) and try to get back into work, im just worried that if i cant do the job i wont beable to claim anything, since been on benifits (about 10 months) this has caused me nothing but problems,

    will my housing benefit stop aswell now??

    Your HB will not stop, as you can still claim as you are on a low income. However, you will need to advise the LA that you are no longer in receipt of IB. You can email or call them - if you need me to find you the contact details just let me know which LA you come under.

    Do you think that you are fit for work? Do you have a psychiatrist or a CPN? It would be worth talking to them before you took this step.

    JSA claims are not taking too long at the mo, though it may still be a few weeks until you get any money. You can claim JSA whilst you are appealing your IB decision, or a reduced rate of IS (depending on your household income). Alternatively you could start a claim for ESA, but I would not choose this route.

    If you see the Mental Health Team at Queens or the Stonebridge Centre (or the person you see is based there), they do have access to a Welfare Rights Worker there. I am sure that others do too, but they are the only teams I know for definite.

    Assuming your doctor still considers you to be unfit for work and is happy to keep issuing certificates you may as well appeal. You will continue to get ESA at the assessment rate whilst the appeal is pending, which may take many months.

    To have a chance of winning your appeal you will need to provide some specific evidence to support your case. A letter from you GP, consultant and / or (if you are seeing one) copies of any letters from a occupational health department to your work.

    More important of course is to get help and treatment to get better but this kind of additional worry can't help.

    Pants, sorry, ignore the stuff about going onto ESA or IS, I had momentarily put you onto IB! You can continue on the ESA assessment rate whilst appealing, you need to advise the JCP that you wish to do this (they will send you a form) and you will need to keep submitting med certs!

    Must stop trying to do two things at once!

    when i rang the dwp benefits people they said that my housing benefit would stop, they are the ones that have made me worry:mad:

    thanks i will ring the la, i will find the number cheers, i dont have a psychiatrist, to be honest i do feel like im ready to get back into work, i think the best route would be to claim jsa and appeal the decision too, i have been speaking to a councilor over the last few weeks, after about a 8 month wait and she has helped me alot.

    what it is i lost everything at the same time and couldnt pick my self back up, lost my family (the ex mrs left me and took our kids) lost my job and the family home,

    wont go into much more details, but i do feel like trying to get back into work. I just worry about what will happen if i cant do it.

    thanks for your help, so if i send in my appeal letter/form and start a new claim for jsa is that ok??

    also my money has stopped from the 1/11/09 so will i also beable to start my jsa claim from that date?

    i have now got to go to an appointment next tuesday to fill in a change of circumstaces form?

    but my hb has been suspended

    just rang the la, they have said that they have suspended my claim for housing benefit :(

    May I ask how long the letter took to get to you?

    There are some people recieving the regection letter as much as 27 days after the decison which means 27 days after there benefit was suddenly stopped being paid, totally messing up there LHA etc and resulting ing bank charges etc.

    not recieved a letter from hb yet, i rang them to inform them of changes and ask the questions about it being stopped off the advice of this forum, but she did say that i would be recieving a letter shorltly

    Its the time the ESA letter took from descion to dropping on your doormat that I would like to know, they seem to be taking weeks and thats unacceptable when benefits are stopped the date of decsion and its leaving people with very little time to appeal, not that the rejection mentions appeals except once thats well hidden in the final page and that dosnt even tell you how to appeal.
