I took advantage of this offer when I saw it here too. (Tried to register earlier and contribute but it wouldnt let me  ??? ).

But anyway: I have emailed TS, WD and Index. Also sent a letter to Idex head office.

Surely if we have no contract with them to buy an item from them as they claim, then they had no right to keep our credit card details on file which they charged when the usb bars were dispatched. Therefore they are in breach of the data protection act which states (AFAIK) that data may only be stored if necessary, or with the customer's permission.

Also added to that, as the contract apparently never existed, they had no right to take money from our accounts for an item(s) we did not have a contract to buy. This is equivalent to theft.

As we didnt have a contract to buy anything, then this must mean that anything we were sent (the usb bars) must be a gift.

welcome aboard alpha112 i totally agree what you are saying it cuts both ways dont it. we either had a contract or we didnt. but if we didnt why did they take our money on what grounds.............

Did anyone else refuse delivery, like me?

If so, do they automatically refund your card?, as I have not recieved anything yet.

They are useless.

I refused delivery on Monday. I kept ringing the customer services dept to make sure that my money had been refunded (every day) . It is showing on my card this morning as a full refund (including the postage).

To get the freephone no. I rang 0800 123131 - which is Lx Direct and acted dumb about getting through to the wrong dept. etc etc so they transferred me to index.com staff.......Worth a try!

On topic: Is anyone actually involved in law here? because it would help to know where we stand on that front.

am about to go into law and would be happy to offer my advice on the subject, although not qualified at all ???

Even though we agreed to it, I think an important thing to find out is whether a company can just include any clause they want in their terms and conditions i.e the acceptance of order part . Or is there a point in consumer law where a contract has been formed regardless of T & C's e.g when the payment has been made in full. I had a quick Google and found a few things about not being allowed to have 'unfair ' elements in T& C's but nothing really relevant to our case (which is a bit of an odd one!).

Just got a letter from ASA who say they can't help in this case as the catalogue pic had the original price and not the £19.99 price.
