    Hi all

    I phoned index customer services also, and they  flatly refused to authorise the reserved printer at the instore price of £19.99, have to purchase the product at sale price of 89.99.   Offered to collect but i told her not to bother as i'd just return it instore.  They really dont care thats its there mistake, and keep telling me its out of stock everywhere including instore.  Which it isnt as I have one on reserve.   Not getting anywhere with them. So is this how they are going to behave everytime they make a mistake and dont want to honour an item. :(

    The answer is Yes - they're a private company and big enough to not give a s*** about a few hundred customers who didn't get something as a result of their incompetence.
    They are however very on the ball in making sure they sent us the USB databar - they've got us by the short and curlies because they've taken our money, but they can claim no contract exists because they didn't dispatch the printer! I think many people will be just happy to get their money back and ignore Index in future.
    (And I can't get my refund yet because the so-called collection arranged for yesterday never turned up).
    And well done Trading Standards! - so next time I pay £10,000 for double glazing and instead I get sent a £6 USB databar TS will tell me to get stuffed because no contract exists? Online buyers beware???

    why don't you ask trading standards how it is possible for them to break their own t&c's so it works in their favour? ie they send you wrong product (breaking the t&c's) to get out of formation of contract (in the t&c's)

    this makes no sense to me...surely they can't claim "there's no contract blah blah blah as you can see from the t&c's" if they've broken them anyway??

    give them something to put in the paper
  • just sent an email to the news paper although i must admit it looks like i'll be returning my "printer"
    funny though cause if I bought a printer at £99:99 received the printer then paid them £19:99 then I am sure I would be in court to recover the remaing balance. I am now not doing anything else unless a miracle happens before i send the "printer" back >:(

  • I took advantage of this offer when I saw it here too. (Tried to register earlier and contribute but it wouldnt let me ??? ).

    But anyway: I have emailed TS, WD and Index. Also sent a letter to Idex head office.

    Surely if we have no contract with them to buy an item from them as they claim, then they had no right to keep our credit card details on file which they charged when the usb bars were dispatched. Therefore they are in breach of the data protection act which states (AFAIK) that data may only be stored if necessary, or with the customer's permission.

    Also added to that, as the contract apparently never existed, they had no right to take money from our accounts for an item(s) we did not have a contract to buy. This is equivalent to theft.

    As we didnt have a contract to buy anything, then this must mean that anything we were sent (the usb bars) must be a gift.

    I didn't buy a printer (not for want of trying I might add), but I've enjoyed following this thread and wish all of you who did managed to get a 'printer' the best of luck with taking on Index.

    However....this last post left me really, really, really impressed (and very confused) with the thought that went into it :o I'm sure there is some logic in there somewhere - I'll just keep reading it until I find it!

    Once again....good luck everyone - don't let Index get away with this

    Very sorry....I didn't mean to cause alpha112 any offence.  I genuinely was very impressed by his/her post.  I was also admitting to feeling somewhat stupid because although his/her statement is logical and well thought through I was struggling to get to grips with it.  I was taking the mick out of myself rather than alpha112 ;) I would never knowingly post anything that would offend anybody.  Obviously I never thought my post through well enough before posting.  Apologies to all - especially alpha112 ::)
