    just phoned index to get them to come and pick up my printers oops i mean usb cards demanded postage back, (nicely though) he said "dont know if you wil get postage back" i explained it was their error not mine , he says when he puts in code it comes up freecom usb card but when i put in code it says 'no item found'!!!!!!!!!!!!! what are they playing at.....

    when they put in they get usb key and when we do it online it says no item found....When I asked about this they said it was because they were now out of stock of the data key so it doesn't register an item.??I thought it came up out of stock or am I daft??
    Also how can they be out of stock of this data key as everyone doesnt read these posts and some people who ordered MUST have returned their prized data keys unopened so they will have stock......

    All in all there is not one scrap of truth being told here by Index , just a big cover up from start to finnish and this is what gets peoples backs up.............. :'( >:( :'(

    isnt it the case of when the item is out of stock it says ITEM OUT OF STOCK they are playing a one massive wind up game with us i think when i return my goods i am going to put in a copy of my confirmation email and a print out of the page i saved it will not get me anywhere but i just feel like doing it.....

    Agreed, they are trying to wriggle out of this on the sly. They are simply making people more determined to get what they ordered.

    I'm sorry the printer is not available on line at present but fortunately I have managed to reserve one instore could you please email authorisation for me to exchange the databar for the printer at the advertised price of £19.99 as this is the price that was accepted when I placed my order. I have been informed that a contract was formed when my order was accepted and payment taken.

    I'm not very good at writing letters but thought I'd keep it friendly for the time being and see if Index incriminate themselves any further.
  • Here is an email I received today from my local trading standards
    2 things
    1. It is being forwarded to Liverpool trading standards where all these complaints seem to be going
    2. And they again tell us to return the USB key
    Hope this is of use to someone else will be doing as advised except returning my USB key

    Dear Mr **********,
    Thank you for your enquiry regarding your order for a printer from index.co.uk.
    I have been unable to reproduce the circumstances you described. This is not surprising, because index.co.uk had clearly already identified the problem some time ago.
    I am referring your enquiry to my colleagues at Liverpool City Council Trading Standards, who I am sure will also already be aware of the problem.
    In order to resolve your enquiry, I suggest you contact index.co.uk immediately to request collection of the USB Memory Stick incorrectly supplied, at a time convenient to you. I suggest you draw their attention to their Terms and Conditions with regard to orders, specifically "Processing Your Orders and Payment". (You may access the Terms and Conditions here -http://www.index.co.uk/index/rf.inf.RFServlet?pathinfo=index/help/HelpGuide.html and click on Terms and Conditions.) They state that payment will be refunded if they do not accept an order, and that they will contact you with the correct details where an error is found. They state that you may then cancel. They also state that when you cannot be contacted, your order is treated as cancelled. None of these Terms and Conditions have been adhered to, consequently you have the right to take the course of action detailed above.
    With regard to the confirmation e-mail sent at the time that you placed your order, it is simply that - confirmation of your order. You will note in Section 2.2 of the Terms and Conditions that the contract is formed only when the goods are despatched. Incorrect goods were however despatched, so no contract exists. This means that index.co.uk do not need to supply you with the goods offered at the price stated, where there has been a mistake. My colleagues in Liverpool will ascertain what steps index.co.uk took to prevent such a mistake being made, but in the meantime I suggest that you follow the advice above in order to resolve your personal situation.

    @bargainboy I do hope that you are going to ring Trading Standards that sent you this email to ask them what on earth they are on about.They are saying the exact opposite of what trading standards in Staffordshire(burton on trent i think ) have told me....
      Is it me or does anyone else think its strange that the index head office is in Liverpool and liverpool's trading standards are making out that we have all ordered wrong... :-X :-X :-X :-X :-X :-X
      As for quoting their t&c's and saying blah blah blah Section 2.2 of the Terms and Conditions that the contract is formed only when the goods are despatched. Incorrect goods were however despatched, so no contract exists IS OUTRAGEOUS coming from Trading Standards and they should know better.........WE WOULDN'T BE COMPLAINING IF THE CORRECT GOODS WERE SENT YOU DIMWITS (t/s)....
     Me smells a bigger rat in de kitchen than ub40 ever saw so going to forward your post onto Staffordshire Trading Standards and let them fight it out for a while.....
