I was going via a loancheck company but now the solicitors who were appointed have said that after having had no response from the administrators of Loancheck, they are going to deal with my claim direct. I've previously signed a CFA so does this mean I will keep all of any award I may receive and the solicitors/counsel will claim their money from the loan company ?
I would certainly get it in writing from your solicitors who are dealing with it direct that you will pay nothing at all for their services win or lose.
  • Thanks,

I've now asked the question, hopefully this will get moving now as I've been waiting 2 years odd too

Great, let us know how you get on.;)

Another thing that annoys me here with these "claims" companies. As you have waited over two years since first complaining to the firm IF this claim was now dismissed (as some are) and it was a complaint that FOS could have looked into you actually only have 6 months since first complaining to the firm to use the services of FOS so it screws you up on that avenue. So annoying. I just hope you get somewhere with yours.

I have been trying to get some sense out of "Watsons" for almost a year now, they do not return calls, do not answer letters and I have had no correspondence from them since early 2009.

What is my best course of action?

I have two files from loancheck which have been forwarded to "Watsons" and have signed an agreement with them.

I would like all my files back so I can do the back work myself through the FSO. Which I should have probably done originally.

    Any suggestions

    Hi
Please be careful and make sure that they agree in writing to release you from the agreement so you do not get any charges.

I would put it in writing that you require to pull out of your contract for the reason being that they have not been in any kind of communications with you since early 2009 and also the fact that they have failed to conclude your complaint for you as agreed. If they kick up a fuss then make a complaint about the solicitors here.

The more people that complain the better I would say from reading this thread. Also i would get in touch with MOJ and complain about Loancheck. You have then done all you can and I think anyone wanting to pull out after all this time wasting should be allowed to do so without ANY penalties. Its so wrong how you have been treated.

I would also add that you may have trouble making the complaint through the FOS now as usually you have only 6 months from first receiving a final response from the company and taking the complaint to FOS. This needs to be added in your complaint about the solicitors maybe.

I wish you all the best on this.

Seems to me Utube that the contract is very one sided then. If the funders and insurers can remove the cases but the clients cannot even after waiting for over 2 years and not having any forms of communications from the solicitors for so long then surely this makes it unfair contract terms? Surely you have the right to withdraw IF you signed a contract with one solicitor - Watsons - and then that solicitor is not acting? Again you mention "reputable" Law firms.... was this not the case then in the first place? I thought they were supposed to have been placed with reputable law firms in the beginning?

Are you advising that people be patient again then or they will have to pay costs? Aren't Watsons responsible for doing anything wrong if they are not carrying cases on? Surely someone is responsible for this mess?

    Hi UTUBE

you are so truly knowledgeable, do you think sitting tight would be the same for whichever solicitor you are using as i know alot of people on here are dealing with the infamous watsons but my outstanding claims are with a company called 1st solicitors based in stafford.

thanks again for all your help and information so far on this thread.

    Hi Lesley

If your case is not progressing with 1st Solicitors then I imagine it will be treated in the same way as a Watson's case.

I have just had a letter from Dawson Hart solicitors informing me that they are now pulling completely away from Loancheck and its Administrators and running the cases they have directly with the clients.

This is a positive move and hopefully other firms such as 1st Solicitors will follow suit and proceed with the claims regardless.
I am a former Broker, former IFA and former compliance officer, for my sins.

However, I have since seen the light.
