Driving ban

Hi i need some advice please. long story short - i was caught speeding and was sent a letter, as i was away at the time my wife opened the letter but then lost it. As i was caught speeding on the A1 i had no idea which county i had been caught in and assumed (wrongly) that they would re-send the letter. i heard nothing for a few months then a court letter so i returned the form on a Wednesday for a Monday court (maybe a bit late??) i have now been found guilty of Failing to produce and given 3 points (which gives me 12 and a ban until 3 drop off in Febuary) and a fine of £680 is there any way to appeal this?? i have had a look on various website but was wondering if anybody had any experiences with this??

  • probably not, you cant blame anyone but your wife and yourself for loosing the letter then hoping they would forget and do nothing

    Surely you would have got three poitns for speeding anyway and still got a ban?

    I doubt if you've much chance of appealing as it was you and your wife that messed up rather than the courts.

    yooda thunk wouldn't you. However I have a friend with 15 points on his licence as he is self employed and all that nonsense

    Sorry OP but you aren't going to get much sympathy on here.

    Of course OP wasn't going to get a ban; his missus was going to take the hit. :rolleyes:

  • How long does a totting up ban last for?

    The recommended mandatory period of disqualification for a totting up ban is 6 months. Some Courts do exercise discretion and there are examples of 3 months being imposed but in theory, if you reach 12 points and cannot convince the Court that you should be allowed to keep your licence, you are off the road for 6 months.
    Can I avoid a driving ban if I reach 12 penalty points or more?

    Yes, if the Court accepts a submission of exceptional hardship.

    If they were for offences like parking on zig zag lines and other not so serious things compared with 9 points for dangerous driving etc the judge may not be as harsh

    my friend got all his first 12 points for fairly minor things, so the judge was a bit softer. He does over 100k a year and the judges explanation was the more you drive the more chance their is of getting points
