Speeding offence through post requesting who was driving

    Do you know who was driving? (you say you remember it well)
    Not naming the driver gets more punishment than accepting the fixed penalty.
    So if you genuinely do not know who was driving then you need to make and show that you have made vigourous efforts to determine the driver e.g. ask for the photographic evidence.
    If you don't make efforts and you fail to show you couldn't work out who the driver was, then the penalty is worse than the speeding.
    You have 28 days to name the drive, so if necessary ask for the evidence e.g. photos.

    But no, the fact that you were not stopped is not a defence.

    If you do not know who the driver was (and I cannot see that that would be an issue, given that you've already said you recall the journey very well), then you should NOT ask for evidence. You are not entitled to see the evidence prior to the issue of court proceedings. You may, however, wish to ask the camera partnership to let you see the photographs to assist you to identify the driver.

    No one is going to advise you how to go about perverting the course of justice.

    Indeed .... just think about would have happened if someone had stepped out in front of you ... at 40 they would have stood no chance .... at 30, well they might survive, but also you might have a split second longer to miss them!

    Quite! OP, have you not seen those adverts? Be grateful you only got a fine, and didn't kill someone. I can't stand people who speed - speed restrictions are there for a reason.

    Mind you, posts like this can be used in court and the fact you've publicly said you want to find loop holes probably wont help.
