Totally agree, usually carp if used.0 -
14kg of stuff was wrapped in just paper?????
And the courier accepted it like that?????
I find that VERY hard to believe.
How the chuffin hell would you lift 14kg worth of stuff anyway ~ the paper would just rip.
Also agree, it's a buy to sell business.
A sly thing to do to pass the letter tracking number onto Paypal and make out it was for the whole package.
So buyer has money back AND the items, and thinks that is OK?
I don't think so!Tank fly boss walk jam nitty gritty...0 -
If they buyer has been refunded the full amount then the goods don't belong to them and they have no right to sell them.
Ebay is a bit vague about whose responsibility it is to pay for the return of the items though; I think it is up to the seller, but it's not cut and dried.
I once received some counterfeit software and ebay insisted I return it to the seller in order to get my refund. I said that was ridiculous and I'd rather give it to the police; ebay paid me a "goodwill gesture" to cover the cost of postage.
It is possible to claim a partial refund on a purchase; I recently bought a computer on ebay and it arrived minus some software (that I had factored into my bidding decisions); I raised a dispute for the full retail purchase price of the missing items, which was a significant proportion of the total bid amount. Fortunately the seller saw the light and sent me the items.
But anyway, back to this auction; if you haven't paid for the items then they aren't yours to sell.0 -
If both sides are to be believed, then there is fault on both sides. The OP NEVER told us that the buyer was correct in saying that bits were missing. Although as your daughter was ill in hospital I can understand any delay (bit surprised you never mentioned that earlier yourself however). If your listing says it was worth £10 (or what ever) then you have to be prepared to refund that amount when it's not there. If the Thomas box were pictured in the auction, then I too would consider it part of the auction, and would be upset if it were damaged.
I think that the OP has seen that there are two sides, and would probably like to settle it directly with the buyer at this stage, and everyone ganging up on them for coming on here to put their side of the story is not helping her to do so.
Hope that you both manage to sort it out. Good luck.0 -
and everyone ganging up on them for coming on here to put their side of the story is not helping her to do so.
Its both parties choice to come here and air there problems. If they do that they are asking for opinions which obviously they will get. SO accusing people of ganging up is just silly. If they don't want comment don't post on a public board. Simple eh.
There are a huge amount of inconsistency in Mrs CM's story. (i'm not saying who is right or wrong) but when ebay Buyers/ sellers start stating there children are ill and in Hospital and they know policeman peoples Scam radar starts bleeping.(no matter whether its true or not)
By the way my Uncles Cousins brother once new a person who once met someone who's sister was married to a Policeman:D0 -
Hi thanks for all your responses here is my side of the story
Put items on ebay as collection only, Anna contacted me asked if Id consider selling to her if she arranged a courier said yes. Item ended with no bids so relisted and added if own courier was arranged it could be delivered. She won so it was packed IN A PLASTIC BOX AS IN PHOTO with a lid then wrapped in brown parcel paper. Any tips on how to wrap a box greatly appriciated as obviously this was wrong. Parcel arrived no word until a week later when Anna contacted me to say box was damaged. It wasnt included in the items listed but she said she'd try and claim off DHL.
A week or so later she said the case was missing and would I send Cranky crane(worth £30) for £8 said no.
Paypal sent email to say buyer wanted refund for £8 for missing item I felt this was too much and declined writing in te comments box why I declined.
Esculated into a claim giving the options of
£8 REFUND
Full refund once items returned
I immediatly clicked full refund once items returned as this is what I thought best.
Email from paypal saying buyer had agreed and had issued a tracking number once the tracking number had arrived at my house paypal who had froze the funds then would hand them over to buyer.
postman arrived with a letter to sign for it was from Anna asking where the missing item was and saying if I couldnt find it not too worry. Thats wierd I thought she was sending my stuff back, thought nothing of it and went to work.
Then had a lightbulb moment and checked the tracking number paypal had given against the one on the letter.
Sent email to paypal and thats when someone told me to come and ask for advice on here
So thats both sides0 -
This is all the comments from the Paypal claim history;
07/10/2009 12:07 PDT - PayPal: Buyer escalated this dispute to a Claim.
07/10/2009 12:07 PDT - Buyer: Still had no responce or not received anything more in the post?
01/10/2009 10:46 PDT - Buyer: Didn't receive the carry case although, seller has acknowledged this & said it will be sent over a month has passed & it's not arrived yet.
The Police comment was a direct responce to someone's earlier question 'is this a police matter?' I've taken advice via the routes mentioned & they say it wouldn't be, that's all. Not a threat, or boast or anything just like most people do I had someone I could ask & I asked.
I never choose to 'air this on here', I tried every possible means of sorting this out ammicabley before going to Paypal (on Ebay's advice) & as the seller said if the case really wasn't available & she let me know that then that would have been fair enough, just I wanted one & she said she'd send it. I'm sorry if £50 was too cheap but it was the starting price & I was the only bidder, I can't help that.
A big cardboard box might have helped to protect the plastic crate, just seemed ashame it was damaged.
Anyway a few sensible & genuinly suppostive comments to both sides amongst the angry people!
As stated communication between Louise & I could have resolved this simply & quickly without any need for all of this.0 -
Im quite happy to resolve as adults in 1 simple question
track or money which one am I getting back?
I'll even give you £8 for delivery of the track hows that?0 -

Why did you say the items were just wrapped in brown paper, when you yourself have said now in this post that they were in a plastic crate??
Does it matter if the crate was damaged so long as the contents were fine?
Why did you pass the tracking number for the letter, onto Paypal, when it should have been a tracking number for the parcel?
To me, it sounds like you knew exactly what you were doing and have done it in a sneaky way, because you knew that Paypal were waiting on a tracking number for the parcel, NOT a letter.
And why send a letter anyway, why not email? And why not send the letter normal mail instead of being able to be tracked?
You've pulled a fast one and it's plain to see that through all your posts here.Tank fly boss walk jam nitty gritty...0 -
After reading all the replies from seller and buyer, I would happily buy from Chester, but Mrs CM you are on my blocked bidders list and I would not buy from you as you appear sly and underhand.0
