    I think you should send her a (recorded delivery) letter stating that unless you receive payment of £50 for the goods she has received within 7 days of receipt of this letter, you will be starting small claims court proceedings against her.

    Also notify her in the letter that the matter has been reported to the police, you have been issued a crime number, and you have also reported her to HMRC for failing to declare herself as a business.

    20p says she'll send you the £50 within the 7 days.

  • Pink shoes I dont think she'll give a toss to be honest, Ive got all the items which she's selling that are mine on ebay watched so Ican copy for evidence, I should've guessed when selling all the trains she sent me an email saying she only wanted the 'brand new' looking ones but she gave a sob story saying they were for her sons birthday. Turns out she was just wanting to sell them on. A valuable lesson learnt which in a way is sad because Ive dealt with plenty of honest buyers on ebay who admit they buy to sell. From now on its car boot sales only for me. Although Ive placed a few bids on her stuff ;)

    right i would take a screengrab of every thomas part auction
    a screen grab of your auction(before it goes from ebays servers)
    screen grabs of all the paypal gubbins showing the tracking number supplied for return


    for me this is surely worth going through the small claims for?
    also i second a report to HMRC

    Thanks to the kind people who have referred me to these posts.

    I'll reply in full later once me little boy has gone to bed but just a quick note to say a huge amount of what is said in this post by 'chester19760' is totally untrue & obviously if at any stage she had done what she said she would do or even replied to either me or ebay / paypal none of this would have happened.

    I have all the correspondence, emails, messages, packaging & a copy of the letter I wrote to her (which she's hasn't mentioned).

    The stuff I'm selling is not & never has been hers - I'm happy to send photos to anyone who wants to see the vast train set my Son has which I'm trying to thin out before we move house (I still have the stuff I bought from her incidently - again pictures available)

    This is definaetly a case of don't believe all you read!

    I'll fill in the full story later tonight for anyone who still cares at this stage!

    PS my Sister & Cousin both work for the Police & I can confirm that there is no way this could be constitued as fraud. Ebay & Paypal have advised me what to do at every step of the way & she has refused to talk to me or them!

    If you still have the stuff from her, why get your money back from Paypal?
