    :grouphug: I have been lurking on this board for a while and i must say that this post made me mad enoughto register and jump in. What a nasty piece of work your ex is. I hope things work in your favour in court. Please try not to dwell too much on regret...Iam a single parent as well and I really admire you for buying your properties in the first place. you wern't to know that your ex would turn out to be such a beast, and you obviously worked hard to securea future for your kids. I have had to start again fromscratch and have £23 grands worth of debt to clear before I can even think about securing a future for my little ones.
    As far as the tax situation is concerned he is talking rubbish its HIS responsibility to sort out his own books. If he 'gave' you his cash, he should still have receipts etc. I can'tsee that one standing up in court.
    Why do solicitors even take on cases like this. The man is just a chancer,but you,my dear are a brave and honorable woman. Dig deep,be strong and we will be thinking of you.:grouphug:

    I think that depends on the outcome and the judge. Correct me if I'm wrong someone, but this has to be a High Court case because of the amount of money involved, hence the need for Barristers?
    I have every sympathy with the OP and can't believe that anyone who works "cash in hand" will ever look convincing in court talking about verbal agreements of monetary arrangements etc. I also would be interested as to what line the Revenue will take, given that he may have to disclose his cash earnings while effectively being on oath.

    re the costs: as I 'understand' it - the judge will probably find it all too confusing and ask us to settle - say i offer 5k and he refuses which he will because he recons hes gona get about 50k- then the juge will probably make a judgement. if the judge awards him 6k ive lost and i may be liable for his costs. if the judge offers him 3k ive won but he wont have to pay my costs because he has nothing to pay with. long and short is he gona get something coz he built a garage (thats stil full of his c**p) after 3 years so it looks like its down to me to try and guess what the judge would award and try and go a bit higher

    and im hoping that a judge who probably pays about 40k a year in tax will thinks hes a jerk as well :-)

    Write down everything you can remember anout his tax paying or lack of it and visit the inland revenue and ask for their advice.
    Visit the bank and get duplicate statements.
    If he gave you all this money i expect the inland revenue will want to know where he hid it if he wasn't paying tax on it!!
    Why did he not go to the police if you had stolen his money? If he has no proof of income etc how can he prove the money existed. Is there anyone he did cash work for that you can give their names to the inland rev?
    Incidentally where is the property abroad? I know 2 people who are looking for holiday homes/property abroad.

    This is a warning to us all to look after ourselves.
    I got ripped off by my ex-husband married for ten years he seemed a loving man thought it was going to last forever. Didn't get any warning signs. Left me in a financial mess and then ended up with a large share in my house.

    well the irony here is that he didnt actually do many cash jobs, u know repairing afence panel for 120.00 straight in his pocket. nothing major really, and i probably didnt know about all of them becuase how would i no what job he was on anyway once he went out of the door. the thing is he's leading solicitor to believe that he was earning mega bucks because either his ego wont let him think that i earnt more than him and paid the lions share, or he knows he's lying and hes trying to scare me becuase he knows i was always paranoid about the IR. Maybe hes trying to scare me into offering something. why he didnt go to the police was a point i raised. i mean his sol actually sent me a letter last year demanding the return of 20k i had 'stolen' from him. in actual fact it was the remainder of my excess mortgage money that i had put in a joint account and swiftly moved when he left and he justs assumes its his and then on the other hand, says in his opinion i borrowed too much money to buy the apartment and im thinking wot has that got to do with him anyway how much i borrow on my house !!!!! anyway he didnt take me to court for the 20k either ! hes just added it onto the latest salvo. atm i spent,stole, saved and was responsible for ALL his earned income. I conned him into thinking the house would be half his. Hes spent 25K on materials doing up my house. I stole 20K off him. i mean well i can see he spent 25k all in on various bills, food etc over 5 years - big deal ! but 25k he spent + 20 i stole _ 25 doing house up and oh yea he spent 12K renovating my brand new apartment as well- adds up to 82K and his declared income for those years was 37k and he was getting tax rebates every year - its ludicrous.
    anyway calming down now.............. apartment is in torrevieja, near alicante
    oh yes apparently he has given me the 'opportunity to live in a beautifully renovated family home whilst having the luxury of being able to holiday in a well appointed foreign property' Dont solicitors speak total c**p. i have a 3bed ex council house with a garage he built and a kitchen and bathroom he fitted that i paid for and ive never been over the doorstep of my well appointed foreign property! oh i musnt forget he did put the furniture i paid for in there and clean it - must be 1/2 his then eh !?

    I think the crux of the matter seems to be there delcared income 37K, outgoings 82K, where did this money come from? Was this 37K a year or for 'x' amount of years?
    If its for the lot where else would he be able to live for that amount of money. I would suggest these maths to his solicitor or at court? Have you got any receipts for any materials, if you have I hope you carded them and not cash, as he could say that was his money.
    I'm glad he hasn't scared you into an offer, just think how much money you will make from them magazine articles where you sell your story when you've won!! Why isn't his sol. going by his income records? Its just daft, of course the sol is getting his fee I guess.
    Going by the fact he wouldn't even get a mortgage on his salary where do they think he got 82K from all of a sudden, maybe the police should investigate him if he can cough up this amount of money suddenly!!!!!!!!
    As for the offer, can you offer him a share of the debt he has left you with - can you not put it across the situation you have been left in?
    If you can prove he's lying on all the other things why is he not lying on the matter of money?
    If by some slim chance he does win as he has proved to them the income the first port of call would be to the tax man. Incidentally if you do win, take all the evidence he's offered as proof of inceme to them anyway. What a b*****d!
