What an awful story! I work in the legal profession (although am not a solicitor, merely a paralegal) and I would be amazed if the Judge awarded him anything. In so far as the costs you have paid for your solicitor to date, I would ask them to provide you with a full Bill of Costs detailing all work undertaken to date and disbursements (ie expenses) paid out in respect of this case. At the end of the case you might well be able to have your legal bill reduced. When you attend Court be as calm as you possibly can, Judges do not like to be swamped with anger and emotion, it fuzzes their brain! What you ex is saying doesn't add up at all - you won't need to hire a hitman - give him enough rope and he will hang himself! Also personally I wouldn't offer him a penny - it may seem like you are backing down and agreeing that he has a case against you.

I reckon he's trying it on, he won't turn up in court, and his solicitors won't care as they are being paid anyway! IMO he's bluffing and making you pay for it, or he was hoping that you would settle before going to court. Take it all the way:mad:
I'd let it be known via his friends that the IR and Trading Standards are very interested in the outcome this court case, I am sure word would get to him about them and put the frighteners on:rotfl:
Question. If you have had to submit your evidence, has he submitted his? surely both side must see each other case in order to defend it?

re his evidence, the only 'evidence' he has were some receipts that incidentally were off my credit card - now hes saying that even though its off my card ultimately his income would have been used to make the repayments - ive given copies of all credit cards staements back for 10 years and a spreadsheet showing our respective purchases and repayments = he only vere paid a few hundred quid more than he spent.
he wants to know where the money is my building society book came from - well the balance was t/ferred from one account number to another when the bs changed the accounts as they do. ive done copies of all the books, most of which are 'dead' and done spreadsheet showing where the money was moved to another acount,where i put some in my kids names - all this money was mostly saved b4 i even lived with him.
his other 'evidence' was an E111 form with his name 'showing he was a memeber of the family!' - i mean like you would bother to fill one of those in for everyone in the house seperately !
a copy of a will i wrote out wen i went away one day and paniced at the airport. I left all to him and kids but posted it to MYSELF with a witness. he opened and kept it. We had an argument abt it and i said i would only ever leave to him if he in turn left to my kids at which point he said something nasty and pointed out that he had 2 kids as well (that I dont know and one of which was born while he was 2 timing me !)
apart from that its all in his head im afraid and i truley believe our legal system is a mess and our laws are c**p :-(

as for being calm in court mrs optimist i think im gona have to take a couple of valium. Im so scared about it but then i think he will be too. and btw he will turn up because he actually believes what he's saying im convinced of it0

oh mrs optimist being a paralegal - his legal aid paid for a barrister and a solicitor at a directions hearing ! i was only given an assistant solicitor apparently thats all you need lol0

Like I said before sad and mad, make sure that your Solicitor only charges you for the assistant solicitors time, and not as if he/she had done the work their hourly rate is a lot less than a fully trained up Solicitor with years of experience - 185.00 per hour here in Devon. I deal with the costs side of a case and know full well how other firms can really take the proverbial with the costs - especially with a private-paying client. I would also think that the fact that you dont have Legal Aid but are prepared to pay to fight your case will go in your favour - why waste your money if you think he is right?
You sound like you have all the paperwork to back your defence - his case is based on assumption and heresay - I find it very hard to believe that any Judge will find in his favour, especially when you have children involved. My respect goes out to you - I would fight all the way myself if I were in your shoes.0 -
ok mrs optimist, i will check out the costs - but after the court case, its stupid but i want my solicitor to like me coz then i think he'll believe me and then he'll fight harder :-S
re the legal aid yes i though that too, along with claimants stories about his big wages which i 'needed' to live on and then he claiming legal aid !
btw my children are not so children any more (19 and 21) so unless i get meself another dependant quick, they wont enter into it if i get a get a judge who thinks i should sell. thats the hardest part of it, i dont want to live with them and i dont like living with them lol but i know they still need me, in no small way because of the way we had to live with him - i feel guilty about all that but thats another story.........thanks x0 -
