    As they say "A verbal agreement is not worth the paper it's not written on". Lets hope it gets chucked out of court on the 19th. We'll keep our fingers and toes crossed.

    Don't forget the judge will have seen this type of scenario over and over again.

    Make sure you have copies of any receipts/statements etc relating to money you've paid out and essentially proving that money wasn't coming in from him. If he claims he gave it you cash in hand then he'd have little to prove it as you should request a receipt for a cash in hand payment signed by the recipient. When I pay my part of the rent to my partner I always transfer it from my bank, plus I buy groceries with switch and keep my water bill receipts, incase anything went wrong. I've been ripped off by an ex and unfortunately was silly and leant him money without getting a repayment agreement drawn up.

    re receipts - well i am a bit of a hoarder so tho i havnt got receipts ive all my bank statements and cc statements for 10 years !
    i hope your right singlehouseholder - it cdnt happen to a nicer person.
    and on a bright note ive been reading all ur advice on other things and to take my mond off it all im gona become a mse. my shopping budget for four of us this week is 25 quid (not for bread, milk, cleaning etc)LOL. im keeping a spreadsheet (i just love em) and will let you know...............

    I have spoken to someone at work about your case and in their opinion it is for your ex to prove he has a case - not for you to prove he has not. The burden of proof is on him and from what I have read so far he hasn't got a cats chance, his record keeping isn't likely to be anywhere as good as yours. Obviously the end result is down to the Judge on the day but again I would reiterate - why would you splash out on defending a case if you thought you were in the wrong? you wouldn't would you? I would make sure that your solicitor reiterates this to the Judge at the Hearing - you will also have the chance to speak and you should reiterate this yourself. In so far as the Bill of Costs, you should wait until after the case and ask for a complete breakdown of the legal bill, together with details of your payments on account to date. Make sure that the hourly rate charged by your Solicitor has already been provided to you separately in writing - this is called a retainer letter. Hourly rates change from year to year and are normally set by the Court themselves - if you are charged more per hour than the retainer letters state, the Solicitor is obliged to reduce the hourly rate to that specified. But I digress... you have enough to worry about at the moment, just let us know how you get on.

    Hiya,

    If the judgement goes against him (sure it will, it's a joke of a case) then be sure to have your solicitor put in a request that you be awarded a percentage of your costs against him, due to the spurious nature of the claim. Failure to pay up on his part will be considered contempt of court, and could result in fines and a custodial sentence.

    Revenge isn't mature, reasonable or clever, but do it legally and it feels quite good. :A

    Hope it works out for you - put some faith in the judge, as they aren't all barking old nutters x

    mrs optomist - thx :-) i am hoping that logic and common sense will come into play here with the judge. as i understand it, we have to go through the 'process' whereas i was getting really frustrated expecting his solicitor to tell him he didnt have proof and not take the case on ! oh well we cant change the system..........he has started this 1st with the land registry trying to get his interest registered, then sort of stopped and gone to a different solicitor, and I dont understand why his solicitor has gone quiet with the land registry, after all i could just sell the house and disappear - except im not gona give up my life for him.
    thx also bargain betty, shame there isnt a board here for small irritating revenge plots lol
    well maybe i'll start one........i just think that the powers that be should have made it clear that there is a danger this can happen. im not stupid but i had absolutely no idea he could do this to me........i wonder if i'm alone ????

    Just read your thread - didn't quite follow all the nitty gritty (been a long day and I'm tired and stupid now).

    Just want to wish you all the luck in the world with your court case.

    At least you've got rid of him and can rebuild your life and future. Like some of the other posters I also believe "what goes around, comes around". He'll get his just deserts one day when all his bad deeds and wrongdoings come back to haunt him.

    Keep your chin up, you sound such a strong and positive person, you'll be fine. He, on the other hand, will end up despised and friendless.
