    thx lessonlearned and rhk001. he dosnt have 'm'any friends to be honest and in that regard im rich. i cant claim /offset for the rent, ive asked, i would have to do a seperate court claim. it boils down to : because we wernt married, he can charge me for work he did but i cant charge him. if his business was doing well (which it isnt and never has done) i couldnt even claim some of that (i set it up for him and helped him run it properly with great opposition from him i might add because he never did any paperwork and couldnt see the need) If we had been married and his business was worth x amount I could claim some of it - well thats the way ive been led to understand it anyway. the point is most of us really know the law and it needs to be spread that you cant really let anyone move into your house or do anything for you without legal avice coz it might just come back and bite you on the bum !

    Im not so sure the garage he built should be underestimated. He left in 2003 and he's left his stuff there all this time.
    While it's true you probably couldnt claim retroactive rent up till now (since you had no agreement to do so, verbal or otherwise) why don't you make this a bit more interesting. What if you sent him a certified letter stating that you have stored his property for x months (since whenever in '03) and that you will no longer do so. Advise him either he should come at an agreed upon time (when you are not there but a trusted friend or family member is to supervise) and remove all items, or else you will have them taken to the local landfill and send him the bill for removal. Give him 30 days in which to act on this.
    You might get nowhere with this, but it will prove a very important thing to the judge. You are being very reasonable by not trying to claim back rent on the garage (due to no agreement) but by sending a letter you are now showing that the situation has changed. The judge might actually ask you why you haven't done this yet. Just a thought. I was in a terrible relationship once too that my husband literally saved me from. My thoughts are with you, you're doing great!

    hmmmmm ive tried that. we arranged for him to come round in december. i had emptied the attic of all his stuff, he picked thru it saying it was rubbish, we had an argument and he left. i wrote to his solicitor saying he had 14 days. his solicitor said i hadnt given him long enough and if i got rid of it he could claim charges. so i have got rid of a lot of stuff he wont miss and used my letter asking him to get rid as evidence and taken pics of it all. so glad youve been saved - i must be living in the wrong town - the men all want saving here or the obvious !
  • Could you send a letter to the solicitor saying you have now given the plaintiff 150 days (just 5 months x 30) and the rubbish has still not been removed? I'm curious to see what the response would be.

    re receipts - well i am a bit of a hoarder so tho i havnt got receipts ive all my bank statements and cc statements for 10 years !
    i hope your right singlehouseholder - it cdnt happen to a nicer person.
    and on a bright note ive been reading all ur advice on other things and to take my mond off it all im gona become a mse. my shopping budget for four of us this week is 25 quid (not for bread, milk, cleaning etc)LOL. im keeping a spreadsheet (i just love em) and will let you know...............


    That's good news - I'm a hoarder too! It always pays off! I'm assuming if he loses he'll have to pay your legal fees?

    hmmm re his stuff, yes i'll suggest to my solicitor when i go in this week.
    Re legal fees - well even if he loses outright and even if im awarded them, i'll never get them coz he has no assets (that anyone can prove anyway)
  • At least you will have saved your home though and its probably worth the money to see the back of him and his ridiculous court action which we're all paying for!
