  • Beks I hope you get it sorted soon hun, When you look at the population of this site alone when you name and shame the toe rag will put quite a large dent into his profits. Make sure you post it on every other wedding forum too once it's all sorted.

    If they have no records of your booking, what's the £5,000 for, then?! Your banking records show it went to them, and the paper/computerised trail will show they received the money. If you had sent money to them by mistake, they would be legally bound to give it back to you, as it didn't really belong to them in the first place.

    Where abouts in East Kent are you?? DM me if you prefer? I work in the area so may be able to look into venues from 'insider' view ;)

    Thanks everyone. He has until tomorrow and then we will be filing the court papers (will get advice from consumer direct and trading standards tomorrow which is his final day to reply). I am resigned to the idea of court now, we have no other options.

    My dad has done some digging on the venue and this will be the fourth time they have been taken to court in the past 3 years (all other cases have either been won or he didnt turn up). Once we get the verdict (which will hopefully be in our favour) I am ready to slate the venue by any means possible (obviously dont want to be done for slander though)!!!!!
    H2B is desparate to go storming round there but I am trying to keep calm and do it the right way, that way he wont have anything to sling at us in court .... does anyone know how long things like this take to get to court????! x

    Thanks, have just had a look at link and hoping to be able to file our claim online (this is what one of the other people who sued them did).
    The £5k is what worries me a little - we paid £4950 and obviously would have to pay court fees on top - presumably we could not claim these back as it would take us over the limit so he loses nothing by going to court. :mad:

    No, it was done on a solo card and it wasnt until we had spent 8 weeks trying to contact the venue that we contacted the bank. Unfortunately, they couldnt help.

    The £5k is just the recommended limit, you can file case online up to £100K. The costs will be awarded to you if case is won but is not part of the £5k limit. The fee is usually not that much, will try and find out exact amount.

    Okay, to file online is £100 for a claim up to £5k. More to do it at court itself. You will be awarded that £100 back from him, if case is won! HTH
