Wedding venue problems - want to cancel.

    The letter we gave him said that he had seven working days to reply and then we will be taking further action so we have to wait until a week on Monday (its gonna be a long week!!) then get back in touch with consumer direct for the next step. He said he wasnt happy to give a refund as he hadn't done anything wrong and it was our problem if we had changed our mind!!!!!! I do think it will have to go to small claims (which we only just qualify under) and I just hope his lies dont get believed (we have the proof to back it up our end but I do not trust him and can imagine him making up the paper work in retrospect to get his backside covered! Its gonna be a struggle but he isnt having £5000 of our money.

    You should have asked him, in that case, what had he done right :D

    Cheeky git, can't believe he can't see what the problem is!! If they have lost the paperwork, then there is no contract, which means that there is no wedding taking place for which you have put the despoit down for, which means he should give it back to you!

  • Goodness me what a soap opera! Nope I'd be spreading the name of the venue all over the internet, do it with a different user name if you had to. If I was getting married I'd want to know.

    Keep pushing trading standards for advice, CAB, recorded delievery for all your corresponence, hope you've now got wedding insurance sorted now.

    I would have named and shamed by now - I work in the events industry and want to know which venue it is to avoid at all cost!

    Kepp us posted gal and keep strong, you're in the right and he knows it. You don't want him holidaying on your 5k!!!

  • You 've got to make sure you do everything by the book your end and have copies of all your dealings ,recorded delivery etc..Good luck you have got lot's of support !

    Thank you all so much for your support! It has been so helpful to read other peoples views and it makes me more determined which is what I need. I am usually a pushover but NOT this time!!!!
    LOL Shellsuit, I wish I was that quick on my feet at thinking, was just gobsmacked at his lies at the time. I dont have the gift of the gab like him!!!
    Once I have this little 'blip' sorted, I am certainly gonna be a frequent user of the forum, I have read so many fab threads on here - really useful.
    We are going to a wedding fayre tomorrow - I know we shouldnt and it is tempting fate (we wont book anything as we have no money left now!) but at least I can start dreaming again and not dreading the phone calls to the venue knowing I will be fobbed off again!!
    We are trying to do everything by the book and for that reason (and that reason only) I have not published the name of the venue spoke to consumer direct about it and they recommended not to as it will most likely go to court. Believe me, I am so tempted and dont want anyone to go through this but dont want it to lead back to me and because of the name of it (its quite an obvious name), if the owner googled it, I think it would lead him straight to it. I might be being paranoid but dont want him to have one up on me!!

    Thanks again everyone, it is so reassuring to have support. I know I have made mistakes in leaving it so long before making an issue of it but I dont think we deserved all these problems. :D

  • Just read through your saga Beks and I just wanted to say - stay strong and determined and you'll get there!
    With all our good wishes and support there can be no other outcome - then name and shame in flashing neon lights!

    We are now 9 days since delivering his letter (7 working days!) and have had NO response!!! Can't say I am surprised, but I did at least expect something, even if it was to aplogise or deny it all again!! Spoke to consumer direct again (who have been sooo fantastic at talking me through everything and helping me write the letters!!) and they have advised to write yet another letter and give him another 7 days to reply .... then it will be court! We have done this and sent by recorded delivery today. My other half is desperate to go over there and give him some grief but we know it's not worth it. I am now getting to the point I just want to cry. He has turned the best day of my life into a living nightmare and we are still over a year away. Until he refunds us, we can't book a wedding elsewhere and everywhere will be booked by the time this is sorted. Looks like we will have to go for a 2011 wedding instead.

    Beks, still keeping everything crossed for you. Look at other venues and maybe get your name 'pencilled' in if you like a place. Explain the situation, its likely the 'new' venue will be falling over themselves to prove they are better and will 'know' of this venues behaviour (it can't be a one off!) and be prepared to hold a date whilst you get money back! always worth a try??
