    Now aim to go to court on Monday TOGETHER and submit the papers. I wasn't sure if they would accept me handing them in without OH there as his name is on the papers (it has to be him as it came out his bank account!). I didn't fancy the possibility of yet another wasted trip to the courts today :o!
    Baby steps lead us to the end, then it will be a case of waiting for his response and then the hearing. :eek::D

    Court forms submitted today. Didn't add on the interest so we only had to pay the £108, better than £225 particularly when we have no idea whether we will get it back. The papers will be sumitted to the 'defendant' before christmas and he then has 14 days to respond. Whatever the outcome, we will hear from the court. They don't know when the hearing will be, it depends on the response. Definitely after Christmas though. Fingers crossed please everyone! ;)

    Hi, well I've been reading through the whole thread over the past few days in absolute amazement and getting madder and madder!! I also read the reviews (after the clue about 'hot animal'!!) and feel incensed for you and your other half. I'm so glad you've put your court papers in and feel sure that you'll be successful in getting your money back. This man sounds like a real slimeball and quite frankly I'm wondering how on earth he's still in business!! The hotel and its staff sounds disgusting. Anyway, I just wanted to say well done and stay positive! (Easier said than done!!) I'm sure you'll both come out winners in the end and your wedding and future life together will be amazing! Good luck to you both.

    Court papers have been delivered to the defendent :j - posted by court on 11th December but counts from 15th. He has until the 29th December to return his reply. He can also request an extension of 28 days (fingers crossed he doesnt though!).

    I have also found out that the venue does organise the registrar - - I now need to find out from the registar whether this has been organised. They haven't contacted us so I can only presume they have't but i have no idea about time scale and when we would have expected to hear. If I can prove that nothing has been organised and it should have been then it may give a little more amo when we get to court.

    Thanks, was supposed to be July 2010! Still a while yet but would have been in the middle of organising if it was still on. :(

    The defendent (owner) had to reply to the court by 4pm today when court closed! At 2.30pm when OH went over there, he had not responded (they had had their post). :confused:

    I am currently away for xmas but OH is at home so he went into court this afternoon. OH is away as of tomorrow, therefore, he has filled in a follow up form which is more or less detailing that the defendent hasn't responded and we would like the money straightaway. The court would not accept the form at the end of today so OH has sent it by special delivery to arrive by 1pm tomorrow! So long as it arrives before the defendent replies (which I hope he is not going to), then I think the judgement goes in our favour (if a judge agrees I think). Think it is called judegement by default. If the defendent replies before the court gets our form then his reply is given priority to ours even though it is late (TBH it would probably be fair as he has had xmas and snow inbetween! :D What a shame!!!).

    It seems a little complicated and does not mean we will necessarily get the money but defintely goes against him and the court will send him a form to request the money. I need to do some reading on what the process is tonight as I forgot to bring the forms with me. I can't say I am surprised he hasn't responded, just goes to show his total disrespect for us and the situation :mad:. My dad reckons its because it doesn't show up as a court case against him on paper. :confused:
