I'm sure that's not true, is there not a local solicitor who could give you a free half hour, even just to ask the papers/slander question?!
I'd try small claims, I don't think I could write 5K off.
Tell you what you could do if you have no joy and it looks like you will lose it.
Don't lose it. If you really, truly feel you can't have your wedding reception there, just have a party there with the 5K instead. The party could be for anything! Just make sure you get that 5K or it's worth back from them in some way or another xxxxTank fly boss walk jam nitty gritty...0 -
Hi Beks, at work so being brief, but I would still pursue the small claims court on the grounds that you gave me, the 'services provided with due skill' (can't remember exactly) The solicitors will be putting you off as this is not a 'good payer' case and is probably out of their remit (being through house insurance) Quoting 6k as costs is what hints at this, as my Barrister plus solicitor for a complex family law case in court over three days was £3.5K, so their costs seem very high. The venue has 'form' and the court will be aware of this. You can show the court that his behaviour has caused you undue stress and distress, and that he has not provided any services so far should mean that he will not suffer 'undue loss' by returning your money as he has said he can 'get another booking easily'

So sorry hun that this seems to have all gone wrong again just as things were looking up. I feel so sorry for you, this should be the happiest time of your life planning your wedding. Feel free to refuse but can i ask which town in East Kent the venue is in, until you are able to name and shame? Take care x0

I go agree with what frannyann has said - take them to the small claims court..also what are trading standards doing? I thought they were going to help you bring the case to court?
As frannyann has said - some solicitors will put a ridiculous amount of fee on something if they actually don't want to do the work...find another solicitor. Use SSAFA (see if they will help).

I can only imagine how upset and frustrated you must be x Is it worth going back to talk to CAB/Trading Standards? I would be tempted to continue with the small claims court, but £150 is a lot of money if you haven't got it. It all just seems so unfair. It sounds to me like the solicitors don't want to take it on as there's not enough money in it for them - which isn't the same as not having a case! We have had a ponder over our next move and with your encouragement, we are going to small claims. I am so worried now but I also feel it is our only way to get our money back. I know we are in the right but legally, I am not so sure now that it will be viewed like that.
I am rewriting our claim for the third time and am going to submit it to the court (it doesnt seem that we can send supporting evidence online hence I think taking it through the actual court will be easier for us).
CAB, consumer direct and trading standards have all given us all the information and help they can. They all claimed we had a good case and gave us everything we needed to take it forward, however, they could provide no further help in terms of the court. CAB provided a solicitor and he gave us info and referred us on to another solicitor who gave us an hour free. Until now, we had only had good feedback. Trading standards also advised court as their final piece of advice.
We can find the money to pay the small claims, but is not money we can afford to lose, that is what is worrying me but it is a risk we have to take.
Thanks all for your help and encouragement. Yet again, it is back to writing out the claim form!!

The other thing I forgot to mention is that we are still trying to determine who is supposed to contact the registrarwhen the wedding is booked. I was under the impression that it was the venue but having phoned the registry office it wasnt too clear and they didnt give a definite answer for me to determine one way or another. I was hoping that this may be another way to prove that they havent even booked that (but I am not totally sure that they were going to or we were supposed to so not something that can be used in court - it's not like I have any paperwork to know one way or another!). Why is nothing easy lol!!

There is a website called bitter wallet I think and people can vote for them as the worst wedding venue in the country it wouldn't be classed as slander, play.com was voted worst company of the day and today its between rbs and royal mail.
