  • Sorry, only just seen this thread. Glad you're getting somwhere with this, i think you've coped amazingly well. Hope you get closure soon x
    P.S Can't wait for the place to be named and shamed, i'm in Kent too so it'll be interesting to find out where it is and i'll make sure no-one i know has any dealings with it

    Well, was keeping positive.

    ... until we received a letter from the solicitor (obtained through house insurance) today!:(:(:(:(

    Apparently, we do not have a case (at all) and there is now less than 51% chance of us winning and they have advised our house insurance that they will not support our claim. They advised they are happy to take on our claim but their estimated cost is £6k. No way can we pay that when they dont believe we can get it back.
    Their main problem seems to be that the venue is not saying we cannot get married there. The solicitor does not think there is a breach of contract and that infact we have breached the contract because we have told the venue we don't want to get married there. Their advice is to go ahead and get married there.

    I have written out the claim for the courts but just dont know what to do, we cannot consider getting married there after what he has put us through but we have lost all our money to him now. I know there are worse things to happen in this world and I am trying to keep it in perpsective but at the moment, all I can do is cry about it. I thought we had a good case and our other solicitor (and everyone else) has been so positive about it. I am just wondering if we have been gullible (yet again) and have lost everything. :(:(:(:(

    There is a way to see who is in the wrong and I can't see why the solicitor hasn't picked up on it.

    The venue don't have your details do they?

    So how can there be a booking for you if they don't have your info?

    You have paid £5K and there is nothing on paper about you.

    Oh Beks and I am sooooooo sorry for you and OH, time for the local rag me thinks!! xxx

    I dont think it will get our money back though adn that is all I want. So upset with it now, I feel like a right pleb!

    Hun, seriously, get onto the local paper/s. Name and shame the venue, the manager and the incompetant solicitor!

    Wonder if the manager is paying the sol a backhander or they know each other, as the case looks so clear cut to me! :mad:

    Oh and hang on, the sol is right in that it isn't a breach of contract, seeing as though there IS no contract, that's the whole blummin' point isn't it! So how can you have breached it at all?! xxx

  • Beks, that's madness, I can't understand why there's the turn around when everyone you've spoken to before has said you've got a case?

    How come they would take the case on for 6k if you've not got a case :confused:

    If you go ahead and file your case with the small claims court - how much would you stand to loose? Is it still worth a go?

    Shell - apparently there doesnt have to be anything on paper to have a contract :rolleyes:, the fact that we have paid that money is enough to form a contract and verbal is apparently enough (I think I was aware of this but still presumed this would be classed as breach of contract)!!! :eek: Yes, it crossed my mind that he is paying the solicitor a backhander but the soliciors is the other side of the country so it would have to be a real conspiracy (we never met these solicitors, it was all done in writing). Oh and if we go to papers we could be sued for slander!!!!!!! WHAT??!!! :mad: I would say nothing that isnt true!

    Joolesw - apparently £6k would cover their costs, they said they will advise the insrance co not to pay as it is unlikely we will win but we can do it through them if we still feel we want to pursue it through the courts (no chance if they believe they wont win??!!! If we go to small claims in would be max of £150 so yeah, probably not much money but we really have no more money to lose, we cant afford a bean atm. I am thinking it is worth a go as we have had so much contradictory advice (everyone until now was really positive) so who knows who is right. It is just so hard seeing it black and white from a solicitor saying we have no case (although they do concede it must be 'very disappointing' but they went on to say we have 8 months left to plan so that is 'plenty of time'. Not quite the point!!! :mad::mad::mad:
    I honestly dont know whether to be angry, upset or just stick to my guns and file the case.
