Been to the solicitors today and been through all the paperwork and now got all the info we need to take it through the small claims court.

Going to work (again) on the statement this week and get that submitted early next week. The solicitor seemed to think we had very good grounds, particularly as their only defence is that it was a non refundable deposit and they have supplied no paper work to support this. Plus we have an email from them to say all paper work has gone missing.

He thinks, for simplicity, it is easier to just sue for our money back in the first instance and go with what the judge says. In some cases the judge will refer to the main courts if he deems necessary.

The solicitor has confirmed information I received from Leylauk (thank you) as to who we are sueing so that is a lot clearer. Turns out it is the owner trading as (name of company) AND another company who they work under. He confirmed that we can add 8% interest from the date we gave him for money to be returned in the first letter (I thought it was from the date we paid so probably a good job we didnt do that). Not sure if he is correct on that though so will look into it.

All in all a positive meeting. Have also had confirmation today from the housing insurance that they will supply us with a solicitor if needed.
The solicitor thought that if we were lucky, we would have a hearing before christmas but possibly after.

So a good outcome so far, just got to get writing the statement and then submit it. :D Thanks everyone for all your help, support and keeping your fingers crossed! :T

At last some progress..you will soon be getting your money back. I think the solicitor has given you correct advice to say to claim interest from the date of the first letter (he's a solicitor so he is not going to lie to you).
  • thanks for the update - sounds positive, keep on with it and I'm sure it'll be resolved in your favour.
