Well, I am sorry to say that not really a lot to report ....
I made it to half the meeting but had to get back to work.
The guy who we saw was not really the right person for us to see, he said himself that the money is much more than the funds that he deals with and it is a complicated issue i.e not a case of paying for something we have not received. I am not sure what his title was but not an actual lawyer (think he was retired and also said he had spent 20 years in the army ??!!). He was very helpful though.
Apparently we have to follow the Practice Direction Pre-Action Conduct - he said it was quite indepth (gave us a 17 page print out :eek:!!) Will trawl through it on a day off!!! Not sure if that is what we have already done but will have a read.
Through him, we have managed to get another hours appointment next Monday with a lawyer in a nearby town. He is qualified and will help us through court if thats what we need to do. He says that he has heard of the venue in question and that the owners name is well known in legal terms!!! He said we had a strong case but did recommend legal help as it is not a cut and dry case. If we don't get it right, it could go the other way. He said we may have a claim for emotional distress but it may complicate things. TBH, I want to concentrate on getting OUR money back and then we can start planning again. However, I do want him to suffer because of this so not sure what to do.
We are also waiting on the home insurance to see if that turns anything up.
looking at the interest, if I have calculated it right, we will be claiming £138 so that takes us well over the £5000 mark. Not sure whether we could take that to small claims.
Anyway, nothing bad but not a great deal achieved. Have to wait another week for more help!!!

Hang in there...the meeting with the new solicitor next week looks promising..especially if the owner is well known on legal terms so he has obviously done something like this before. I would also ask the solicitor about whether or not it would be worth contacting watchdog, rogue traders and the local press and radio.
Remember that if you have to take a day off work then you claim that as time lost and go for loss of earnings too.0 -
