You now have to decide if you want to enforce the judgement. (As you will have realised, the Court Order to pay you immediately (dated 2/6/08) is water off a duck's back to them).

thats great news, what do you suggest i should do? shall i wait any longer to enforce judgment via bailiffs or do it immediately. I am sure there is a charge for it. If there is, will I be paid back along with the previous amount?
unfortunately, all my dealings are via paper format, so i will have to call up my court and proceed.

someone else has just sent the bailiffs in and got nothing, what can we do? they obviously have a loophole by having a virtual office, how can we get through that?:j :beer: :j0 -

None of the above (post details of your situation in the thread)I'm in the same position as quite a lot you you now. I've done the court bit. Won the court bit. MR owe me upwards of 500£ now.
Now I'm reading that I probably won't get that back. Yet it looks like they are still trading. Still selling dodgy contracts they have no intention of honouring. In fact they seemed to have been approved some FSA accreditation by the looks of their footer on their webpage.
So have we just been wasting our time/ money with a toothless court system who can't do anything to shut these people down or get our money back.
My legal knowledge is pretty weak but isn't this called fraud? Why aren't the police involved? 500£ down the swanny!0 -
Quentin, as long as I have complied with these T&C and can prove that then should I be okay?
I do not have a LBA as I had informed them by email I would be taking legal action if payment was not made and also verbally.
Can I also ask, I understand that the T&C require proof of delivery for any cashback claims, is electronic proof of delivery sufficient for this
If you complied, then they have no defence.
Use a print out of your e-mail as the LBA.
A print out from the RM track/trace web page will be fine to prove delivery.0 -

If you decide to risk paying for a warrant (to get bailiff involved), then there seems no point waiting.
The cost of getting the warrant is added to the claim, and the bailiff attempts to get the total off them for you.
If you read others experience, it seems it is not straightforward for the bailiff to trace them, and paying for enforcement may be a waste of more money.0 -
I was concerned as i am about to go down the 'fundamental breach' route with onestopphoneshop and wanted to be sure. I doubt there is any difference but can you recall anybody being successful with a fundamental breach - full cash back claim based on 'auto' cashback being late?

I had to issue legal proceedings to receive some/all of my cashbackCCJ's against MSOLS update...
121 CCJS totaling £37,500
Last one that's registered as being paid was on 21st May.
I tried speaking to legal department at FSB yesterday as I'm a member but they weren't any help. Just asking them what one does when you have a CCJ against a company with a virtual office address. No answers as yet...
Are there companies that buy debt? Guess there are for larger amounts, but are there any reputable companies that buy smaller amounts from consumers? I guess that would be an option, but they would take a cut of course. They would then go on and chase down the debtor with their clout. Just thinking out loud.
But we're surely at the point at where the company is trading illegally. And if that could be proven, the company directors would become liable.0 -
