Through no fault of my own I've lost some/all of my cashbackcan anyone tell me about what would i need to take to court, do i need to take all the bills for both of my contracts or will the proof of deliveries will do? and are there any specific points that i need to make to win the case, would i need help from a solicitor or sumthing?
thanks alot!0 -
Hi,
Thanks Quentin,
It is the court who have ordered they pay the £225 so i 'll have to wait until after court date in August to enforce it.
Surprise surprise they didn't make the payment which was due yesterday.
I was also wondering what I need to take to court - I was going to take all bills, emails, notes of phone calls made with dates and proof of posting from the post office.
Anything else I would need?
Likewise I wondered would I need any representation. I have no plans to call any witnesses!
Nicole136 - hope they make that second payment.
Cheers Claire0 -
If there is a court order for £225, then you can enforce it now.
(I am presuming that the hearing you have in August is for a separate claim)
You won't need to be represented when (if) you go to court. If you want to use any documents, then you must provide copies for the court and the defendant prior to the hearing (all this will have been explained in the papers you should have received from the court). Include a copy of the terms and conditions of the offer.0 -
I had to issue legal proceedings to receive some/all of my cashbackHi
How do you enforce a court order?0 -
Usual way is to apply to the court (which issued the order) for a warrant of execution. If granted, it is passed to the court bailiff who will get the money for you off the defendant.(Provided they do have some!)
The fee for the warrant gets added on to the amount already owed by the defendant.0 -
Hi all,
I'm helping my dad make a claim against Mobile Rainbow. He has had a judgment for claimant and this has been accepted by them. However, he has now received something from Northampton County Court saying the defendant name entered, namely Mobile Rainbow is ambiguous. I phoned their helpline and they say it will cost £40 (non refundable) to change the name entered (I assume to Msols Ltd or something they are happier with).
Any advice would be greatly appreciated as this is rapidly becoming very expensive and annoying since a judgment has been made in his favour. Thanks.0 -
You cannot enforce the judgement without doing this. (Whatever the outcome of the case, and whether or not you get paid, this extra £40 cannot be claimed off the defendant or anyone else - it is your loss).
Depending on how much your claim was for it may be cheaper to abandon this action and start again.0 -
I had to issue legal proceedings to receive some/all of my cashbackI have been paid all the money owed to me without going to enforcement of the CCJ. I am very happy to get the money at last ... I can't quite believe it!! Good luck to everyone who is still claiming, and thank you all for your advice, particularly Quentin, who is excellent.0
