  • Just received a response from the FSCS re. my complaint about how Deloittes had handled the claim to date. Below is part of the response which may be of interest to others with a claim against Wilmslow:

    "After beginning work on claims against Wilmslow, we discovered that a number of claimants had already received a payment from the firm. Therefore, we advised Deloitte to continue work on claims against Wilmslow up to the point of assessing if a claim was eligible or not, whilst we looked into this matter further. Please accept my apologies that Deloitte did not clarify this issue for you, and that you received conflicting information about your claim for compensation. I also regret that you did not receive a telephone call from Deloitte when you were promised one. This does not represent the level of service that we aim to provide.

    We are in the process of writing out to claimants in the same position as you about this matter, and I can confirm that you should receive your letter very shortly, if you have not already done so."

    Would suggest everyone complain to the FSCS about how they've handled it. Whole thing has been a farce so far. They dealt with some claims very quickly and then just stopped without bothering to contact those effected. Wouldn't have thought it was that tricky to find out who had already been paid and who hadn't. I've written back to say that I expect the hold on my claim to be removed and since they've made such a mess of things so far that they compensate me by giving me the money now! Won't make any difference I know but makes me feel better just to vent my frustration at how useless they've been :mad:

    Think i will join you in that complaint to fscs.

    Bad News on my claim , received a letter from FSCS saying rejected due to no civil liberty , i rang to clarify and told because my ppi was sold by a broker ( ocean finance ) they cannot payout as they are still trading

    Dont know what to do now , im gutted

    Golly, I am so sorry to hear that.

    So basically then you will have to forward a complaint directly to Ocean Finance now then it seems.

    Get a complaint form in when you can, I know its a pain starting over again, but hopefully it will all be worthwhile.

    How long did you have this case within the FSCS?
    (They could have confirmed on this earlier for you, how annoying)!!

  • My claim started in august with the FSCS and went right until the final decision after going through all thr various processes , im quite annoyed as to why it wasnt noticed the ppi was sold by ocean finance earlier on

    Also , i rung Ocean Finance who told me that the ppi was refunded off my current loan with picture when it was refinanced so i cannot claim , i still think that if they originally sold me £7500 of ppi then i should be refunded if found to have mis sold even if it was supposedly refunded off this current refinanced loan ( which on looking as ppi of £14000 )

    I havnt a clue what to do now

    Hi In my opinion you can make a reclaim on both of the accounts of the PPI.

    For example, mine was the same, broker Twopart/eloan set up and sold the first loan, so it was down to them to whom I had to pursue, even though the lender was Nemo, further on we taken out a loan advance with Nemo and made a reclaim with them as well, as they were fully responsible for the 2nd loan.

    So, lets start afresh on yours if that is ok by you?

    As you were in the same position as me, you would make a reclaim on the PPI for the first loan - the broker.
    The 2nd loan advance would be with the lender as you had taken out a further loan, but these were responsible.

    Yes your correct in saying that you should receive both refunds, however, what happens is when you take out a loan advance, normally there is so much rebate, so the ppi with the loan balance is therefore reduced on the first loan, and carried over and built in with the further loan of the loan advance.
    So if this applied to you where they state they refunded, I think they would actually mean rebated it for a lower balance, so you would not see the money but as a lower settlement balance - where the remainder of the loan minus the rebate was carried over.

    So depending on how much was rebated/used to reduce the first loan, you should be refunded the remaining of the PPI, plus interest.

    Sorry if this sounds confusing, but I'm sure there will still be a refund in that one somewhere for you.

    Please let me know if you can, and we can take this case from there.

  • Just a quickie to see if anyone else has received a form from the FSCS re. Wilmslow to check if you've previously received a payout from them? Loved the fact that on the covering letter is said 'sorry for the delay in sending this'; about 3 months delay I reckon!
  • Completely agree - this has been dealt with appallingly. I have had numerous telephone calls with FSCS and Deloitte and neither tells you the same thing. I received an offer from Wilmslow in April and then never got paid out because they went into administration. Matter has been with FSCS since May and still no nearer an end. I have also written to FSCS to say how badly it has been handled. Interestingly I have received no letter in the post about confirming that I have not received a pay out over the last few days but was asked to confirm by email to Deloitte on 21 Oct that I had not received the offer of redress from Wilmslow which I duly sent back. I have no idea what they are now doing as confirmed then that I had not received any redress and it is now two months later and still no news. I emailed FSCS to ask them at the end of Nov what was happening - they just forwarded the email straight to Deloitte without responding. I then chased Deloitte's twice only to be told all they could tell me was Wilmslow cases "are on hold". The lack of clarity and reliable information is shocking.
