Ah TY Busby. I found a v good letter that somebody had written re after cca 'ing a loan getting the FP to remove the default status they unlawfully placed on your CRA file. !!! Cant find it anywhere and its driving me nuts.

    ta.

On a Picture front, things seems to have gone off the boil a bit. I wonder just how many lurkers on the thread there are? Also do we know if FSCS going to be writing to all PICTURE clients or does it require the claimant to make the initial complaint.

    barloo

There is a sticky - Standard letters to creditors etc. The letter you are trying to find may be on this thread. There is also a link on page 6 of this thread

    Good Luck

Seems to have come to a standstill on the claims, but hope you all hear of at least some positive news this coming week, and also about the other issues as well about the NCB, fingers crossed for you all.

Just a stab in the dark here barloo but I found this one on another site

    Dear Sirs,

I refer to your unlawful termination of the above agreement occasioned by your demand for me to pay the full outstanding balance of the account thereby unlawfully terminating the agreement.

You were not allowed under the CCA to demand any of the benefits of s87 without first having issued an effective default notice giving me an opportunity to remedy the alleged breach and pay any arrears claimed

Furthermore and notwithstanding the foregoing you were in any event prevented from enforcing the agreement by virtue of being in default of your obligations under s78 of the act

There was no lawful basis upon which the agreement could be terminated therefore I consider your termination of the agreement as being a repudiatory breach of contract which I have accepted and, for the avoidance of doubt, confirm that as I have elected to accept your unlawful repudiation of the contract I am therefore discharged from any ongoing liability under the former agreement. save for arrears genuinely due at the time of termination, set against which will be my claim for damages, including but not limited to the damage to my credit reputation as a result of your unlawful actions

I look forward to receiving your proposals to deal with this matter

    Yours sincerely
