i think the process of unenforcibility is a legal minefield, i would not like to go down this route, you will not get legal aid and may lose at the end of the day. this will take more than a template letter and a few stamps, i understand what marshalka is saying and these companys should not get away with using false info, maybe this could be the start of a complaint? but you may need more than that to take this forward to unenforcibility. but i think its what the agreement says that you signed in the beginning that may have certain things omitted. if you all choose to try and go that route i wish you all the best of luck, but a process like this will take a very long time to do and as it says in martins email this is not guaranteed. and you could be chasing your tails, the mbna card that was wiped off was only in a small claims court and does not set a precedence. dont build your hopes up for what may be a costly down fall. it would take a lot to get a secured loan or a mortgage wiped out. sorry to p*ss on your bonfire but that is my personal opinion and i think you have all been through enough this past couple of years and i wouldnt wish anymore stress on any of you. hope the postie brings some good news for more of you today xxx please feel free to shoot me down in flames if i have offended
I have know this for over a year with mine Amersall and although I know I have proof within the SAR I don't think I would like to tread the road of what it may lead to. I am not into this reclaiming for flaws in agreements which is what most unenforceability claims (In fact VERY against it) are for but if you genuingly believe that you have been missold a loan and don't mind the stress of reclaiming it back then people should go ahead. Mine is a case of their word against mine really (although there is proof within the SAR but they could say they had the details mixed up I dare say!!) but I suppose with a consumer credit expert involved they could make head and tail of the actual wages used to get us the loan. Have not decided which way to go yet TBH but I totally agree, its not a matter of sending in a reclaim letter. There is so much legality to it too that has to be gone through and not enough feedback as such yet. I must admit morals do come into it here in that I was actually desperate at the time for the loan and NEEDED the money. I don't think that anyone should want to get agreement voided just cause they can either. You SHOULD repay what you borrow. I think I have made up my own mind here in this post.

  • I have just spoken with Deloittes and have been told (by a rather nice chap) that they have the info they need from target (picture) and the questionaire I sent back last week.

He told me that they are working through the claims chronologically (as expected) but a decision should be reached on mine in a matter of weeks.

I feel the same as a few people on here. Financially I am just about able to wait for the cheque... its waiting for a decision that is going to kill me. :(
