Therefore the unenforceability of the actual loan is still fair game in my book.
If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

Marhallka I don't think you have offended anybody here, you and all of us are just expressing opinions. I do think things "happen" in one's life that makes other things pale into insignificance.
We have all been posting on here long enough to know it's ok to say what we think, without causing any offence;)

My internet connection is driving me mad tonight. Keep losing signal

I hate it when that happens.....

I live across the road to County Hall and the Police HQ and I'm sure we get problems because of that........they have all these aerials everywhere, so makes me wonder if they interfere with the puter..... wonder if they can?

    Hi Folks

The line on the letter is in relation to the PPI because that is what the compensation claim was about it was not about the actual loan - what it means is that if you bank the cheque you agree with the decision the FSCS has made and the amount of compensation paid for the bad advice - by accepting the cheque you then cannot i.e go to a 3rd party and make a claim for being miss sold or being given bad advice re PPI.

Thats good then but you need to find out if the FSCS can look into Consumer credit complaints and if they can from what date. FOS was able since April 2007 and only for loans taken since April 2007. I woud think (although cannot be sure) that the FSCS would have the same remit.

I have a similar thing with Firstplus now and am in two minds what to do:confused:. I am not into this loan reclaiming back cause of little flaws in agreements, in fact quite against it (but just my view) BUT my loan with FP i think was not within our actual capability to repay according to my SAR and I have reason to believe that it was done with made up wages and wage address. We have the application and the wage slips we gave to them and also the P60's too BUT on the SAR is a made up address for my hubby as his address of employment and we have google earthed it and its a terraced house far away from us. There is also a time when I wanted to try to settle with them and they state what my hubby was earning and it was near on double what he was and I argue this with them. It then goes blank and I remember they changed it back again. THIS WAS NOT US though as we have proof of giving all the correct details on the application form. I think we did not earn enough to have this loan and PPI and figures were made up. Have not decided what to do with it yet as they could say they got things mixed up. May go to Citizens advice and see what they say. I think we were set up to fail as they say.

Sounds to me as though you do have a good case here marshallka. I would be very tempted to take this all the way if I were you:beer:

I think they probably would have the same remit, but as i say I don't think my daughter will pursue this any further.

    EDIT

Maybe she and myself ( as It will be me doing all the work)will feel differently once the compensation is sorted. It's just my head feels quite battered at the moment and brain needs a little time to calm

It will either be the FSA or the FOS - whoever is the govering body for selling of loans and consumer credit agreements by the company

If the loan was actually taken out since April 2007 then FOS can look into consumer credit complaints (like this is) But only if the firm is still trading. (although never seen a case where FOS has written off a loan!!) It would be the FSCS if they are able to and I would think they again would only be able to look into things like this since the same date. I cannot see anywhere though where the FSCS can actually deal with this kind of thing. Maybe a solicitor could help???
