Mobiles.co.uk have recalled the HTC Hero - What are my rights?
Last week I ordered a HTC Hero via mobiles dot co dot uk on Vodafone following requesting my PAC code from Orange the previous week.
When my phone arrived I put the new SIM etc in and waited patiently for my number to be ported over, including following it up with e-mails and calls.
Yesterday it wasn't activated so I called again and they advised that the phone had been withdrawn from Vodafone so I would need to send the phone back. I made my obvious frustrations clear and was given the e-mail of a supervisor.
Today I chased up a reply and there is no supervisor in at all. Returns have told me I will be liable for the contract with Vodafone and will have to accept it as I took the SIM card out of the seal and put it in the phone, thus accepting the T's and C's.
My thoughts are to cancel the direct debit as they haven't activated the Vodafone sim or ported my number over and go with another network that offers this phone (T-Mobile). Once that is done they will at some point have to at least have someone such as a supervisor or manager discuss with me as I will not be paying the bill and have the phone.
I'm just wondering if anyone can advise of my rights in this situation as they cant provide the phone I've ordered but are insisting I must continue with my contract.

DSR comes into play - so as long as you return all the items within the 14 days and cancel the contract you will be okay0

Have you actually got the Hero in your hand? If so dont send it back and ask them to activate the sim.
If they wont activate the sim then dont pay for it. You cant be expected to pay for a service that they wont set up for you.0 -
Post a question or send a pm to the rep who is on a couple of threads on this forum with mobiles.co.uk in the header thread. He seems to be keen to answer at present.0

Killbill - Thought that but I'm told because I took the sim out of its packaging and put it in the phone, that it is now not an option. It means I have accepted the T's and C's and must continue with the contract.
barrybarryr - I have the phone in my hand but they won't activate the SIM. Thats how this all started as because they hadn't ported my number I called to query what was going on. At no point have they contacted me to proactively explain there was a mistake.

Hero is now approved for sale on Vodafone so this shouldn't be a problem to sort it out painlessly - could you drop me an email with your order number - ben at mobiles? Ops Manager has read your post and says we can solve this. The advice given to you was wrong, and we're addressing that.

Turns out MSE-dwelling is almost a full-time job, and I already have about 6 of those :eek:, sorry for the delay in responding.

l placed an order for a HTC Hero on Vodafone only to be told by Rebecca Story at Mobiles.co.uk that Vodafone are no longer able to supply a tariff for my order. Why is this, since you say that this has been approved for sale on Vodafone.
This only came to light when l sent an e-mail to chase Mobiles.co.uk for an update, even though l received an confirmation last week that l had been accepted by Vodafone, otherwise l wouild have been left in the dark thinking that my number was waiting to be ported and my phone sent out after.:mad:0 -

I personally have the HTC hero on T Mobile, its a great phone and I got a great tarrif with it.
I pay £35 a month for 700 min, unlimited texts, and unlimited internet, which is handy as its a internet phone.
