While reading through CNM's T&Cs I saw this:
"Where the claimant raises a fallacious claim against us, we will have the right to claim all expenses incurred relating to such claim including Court fees, Litigation charges and Solicitors fees."
I would just like to add that that is a load of hot air. Even if you lose you will not have to pay these costs as long as your claim was reasonable. The reasonableness of the claim being decided by the judge, not CNM. The most you will have to pay is their travel costs, overnight expenses, and loss of earnings (but seeing as they are there representing the company they work for, there shouldn't be any loss of earnings as they are effectively 'at work')
I even think that statements like this in the t&cs could go against CNM in court, as it makes them look like a bunch of bullies.0 -

Yes, you could do. Though the idea of the small claims court is it's informal and solicitors costs are not normally allowed.0

No. If you lose a court case you always lose the court fees as well.
You pay the court fees when you start the claim - the defendant doesn't pay fees.
As regards solicitors fees - they cannot be claimed back unless the judge agrees, and they won't do so unless your case was unreasonable or frivolous i.e. you are suing them just to !!!! them off and/or it is obvious from the beginning that you don't have any chance in hell of winning.
My point was that these sort of misleading statements by companies are simply an attempt to bully their customers into giving up their legal rights.0
