    They cannot extend the payment period for existing contracts. If you are happy to sign up for a new contract with a payment period of 2 years, then more fool you!

    Sending a LBA before they have breached is pointless.

    But as soon as they have committed a breach, you can bang one out.

    I am preparing to send them an LBA in the next few days as they have not replied to my letter - regarding accepting photocopy bills.

    When you use MCOL, is the defendant 'Mobile Media Systems Limited' or 'Mobile Affiliates Limited'?

    Also which one of their addresses should you use - is it the one in Stafford, or the one in Bingham, or the one in 22 Rope Walk, Nottingham?

    I do not want the claim to be invalidated simply because of small technicalities.

    That is the address currently showing at the Companies Register.

    Just thought I would update everyone on my situation:

    Basically I am in the same boat as AP. I sent my claim by recorded delivery, but it got lost in the post. All I can claim from royal mail is the cost of the postage plus a few sheets of paper, so obviously it will be the obligatory book of stamps.

    As far as CNM goes, I have called them on several occasions but get the same response each time, and any attempt to speak to a manager/supervisor is blocked as they are busy/unavailable/in a meeting. However, their website does say that copies are acceptable (in a roundabout way), and they have agreed that they are applying the new Code of Practice, but only for new customers, so I am going to send in a web copy of my bill with a covering letter. I fully expect this to be rejected, at which point rather than going through their complaints procedure, I will send an LBA followed by a court summons.

    How do you know they are not applying the new codes of practice for all customers ? Have they told you this ? They told me that they were applying them to all customers.

    What they tell you one day isn't the same as the next. If it's not in writing it's much safer to assume the worse. If it is in writing you have them by the short and curlies.

    Cheers Bob that would be appreciated, and it could make things a lot easier for people like me and AP.

    In answer to your question, I have been told by several members of CNM staff that the new CoP applies to new customers only who started after either 24th or 31st August 2007, depending on who you speak to!

    Personally it is my understanding that, if the mobile industry have deemed certain T&Cs to be unfair and unreasonable with reference to The Unfair Terms in Consumer Contracts Regulations 1999, SI 1999 No.2083, then any contracts which contain those unfair T&Cs that came into force after the above Regulations will also be unfair under those Regulations. Therefore, CNM should be applying the new CoP not only to all their current customers, but perhaps to all customers they have had since 1999 ;)

    However, I need to check this to with a solicitor because I do not have any legal training and may have misunderstood the law.
