    I sent in the 2nd month cachback claim regardless of the "invalid" status on my account.

    I received a letter today: "Invalid Claim...Dear blah blah, thank you for sending in your recent cash back claim... Conditions require blah blah. I regret we can be no further help in this matter. Yours sincerely." With a note: "Your 2nd claim has been refused as your 1st instalment was rejected. We refer you to our Terms and Conditions."

    Funnily enough, I ALSO received a call from CNM today of all days! "We're sorry to hear you've had to take court action. Just so we can better our customer services we'd like to know why it went this far and we'd like to settle the matter."

    JUST as Neilgb's said: This is the phone call to try and sus me out! Improve customer services my !!!!! They didn't "listen" or "read" any of my previous letters/conversations and at this late stage it's obviously a delaying tactic.

    Anyways, ANNE BOND (telephone number available just PM me for it) who alegedly works in the MARKETING DEPARTMENT (I smell bovine related excrement) offered to reinstate the cashback claim and send the last 2 months worth of claims as well as pay court fees. I told her that I want full reimbursment of the entire cashback claim as I don't want to be dealing with them anymore wrt this particular contract, but nontheless I also asked her to put her current offer in writing. She's said she'll have a word with the people up top and see what they can do and that in the meantime she'll send this letter out via recorded delivery.

    Needless to say I'll be asking for the entire cashback amount as I've seriously had enough of their bull. I even told her that even if they offered to pay the court fees, I'd STILL have been worse off as I'd spent hours on their 0870 number trying to resolve the matter, and I'd spent the equivelant of 4 recorded and special delivery costs in useless correspondance with them.


    Anyways - CLAIM. If you KNOW you've done no wrong just CLAIM! They count on people not claiming at all, lethargy is not an option. If I don't receive full reimbursment for this particular contract I'd be willing to take matters to court. Of course - I'll have a word with TS beforehand ;)

    Court Papers served 2 weeks ago, today got a call from CNM to 'resolve' issue.

    No problem I said, pay the claim in full and it's resolved.

    Offered to pay the two claims refused and the 4th claim which is due now and allow me to make claim 5 as normal.

    No chance said I, why on earth would I trust you to deal with claim 5 fairly after what you have done so far.

    Get this reply " I understand, there are ssome scam merchants out there, but we are not like that"..................... ROTFL " That's not how it looks from where I sit" said I.

    OK so the offer is now to pay all 5 claims, .............I will get a cheque for £332 in the post she said.

    NO, don't forget the court fees I pointed out.

    "Oh, perhaps we could split the court fees" she suggests.

    WHAT PLANET IS SHE FROM !!!

    Fine "I'll see you in court then" was my response.

    "OK I'll get a check for the full £382 sent by recorded delivery".

    Now just have to wait and see if it arrives and clears.

    But at this stage it looks like a result.

    DO NOT GIVE UP GUYS.

    They will cave in if you are in the right.

    Lady I spoke to was same as Yabbas, 'Anne' in Marketing!
  • I placed an order online an expected delivery of the phone today. When I rang asking where it was, they advised they has yet to take delivery of this phone, and did not have a date yet. Funny, it stills shows as in stock on their website? I have been accepted by the Network.

    Anyone else had similar experience? Am I right to assume the contract will not start until they dispatch the phone. The woman on the phone was courteous and polite enough. Should I smell a rat or is it too early to panic just yet?

  • Im sure there isnt really a 'Anne' in marketing. These people come up with so many different names for themselves & their companies i think they are starting to believe their own lies. My claim is currently with the court. Funny how a company that loses so much mail always seems to receive letters from the court. I cant believe that people who use this site are still using this company !!!

    I have had 3 of 5 cashback on one contract, the 4th is late, the 5th about to be submitted. They pay very slowly but have never failed to pay without prompting for me. Assuming they pay the last two installments eventually I will have had 750 mins a month, 500 texts and a handset I sold for £100 all for nothing. Despite their slowness I think that is a result. Yes they are risky but the gains can be large.

    For anybody thinking of pursuing action against Mobile Affiliates, who are unsure of how to word thier claim, below is the text I used. Feel free to use as a template.

    On 22 November 2006 the claimant entered
    into a contract with the defendant to
    purchase a new mobile phone. The terms of
    the contract promised cashback to the
    claimant of 5 equal payments of £84, total
    of £420, subject to compliance with terms
    and conditions of the contract. The
    claimant fully complied with the terms and
    conditions, namely the submission of claim
    forms and original network bills within 30
    days of thier issue at months 4 and 6. The
    claim was paid on the first occasion but
    refused on 20 August 2007 upon the second
    claim, thus barring any further claims
    under the terms at 8, 10 and 12 months.
    This was a breach of contract in failing to
    pay the claim, despite two e-mail
    communications from the defendant informing
    the claimant that the claim had been
    checked, was in order and would be paid.
    The claimant claims the full sum owed under
    the terms of the contract which the
    defendant has breached.

    Well I got the dreaded letter saying I had not stated which instalment is being claimed. I'm positive I did but I could kick myself (1000x) because I photocopied the bill I sent but not the claim form!

    I am still waiting for my 1st cashback to come through (I've had the email to say this has being accepted), will I still get this?

    ANYONE THINKING OF SIGNING UP WITH THESE CROOKS DON'T!!!!!!!!!!
