    Hi everyone (especially Gargrave),

    had some good news today, Mbna have refunded me £1682.94 in PPI premiums. Plus £224 in late payment fees, that's almost £2000 off that debt. With that and my Barclaycard refund I have reduced my debt by £2186. I am over the moon. :j Looking to take on Capital One next as they keep saying no to everthing. Beginning to think if I asked them were they Capital One, they'd say no to that.
    I would never have had the courage to take on the banks if it hadn't been for all the people on here.
    But a super big extra special thanks as to go to Gargrave, without her help and support I would never have seen it through, just knowing someone out there is looking out for you is great. Thanks Hun, your'e an inspiration to us all. X

    Have not read the whole thread through. have you done a CCA request on cap1?

    Hi RAS,

    Yeah I've got the CCA dated 10/06/2009 where it shows quite clearly I ticked the box NO for PPI, they're saying 11 days later on 21/06/2000, I phoned to say I wanted it. (Liars)
    But I've now got all statements and they show that from 10/06/2000 no premiums where taken but suddenly appeared 09/12/2004. I've had responses to both template letters and last one said they'd pay me as a goodwill gesture £150, I've just finished letter saying I'm going to FOS as I believe they took this money without my permission.
    Will have to see how it goes, am also putting in claim for £244 for charges and interest.

    Can you chekc the dates in that?

    And have you checked that the CCA is legally compliant? Does it include all the prescribed terms?

    Do you mean are the dates I mentioned correct or have I checked that they are correct from statement.

    Have got the CCA but not sure about legally compliant as it just a photocopy of application. List of terms and conditions is a pamphlet with no date so don't know if those rules are same as when I got card. Not the most savvy when it comes to finances (obviously).

    If not, then it maybe that this debt is unenforceable.

    Hi RAS,

    looked back over my post, it was me being super dim. Slip of the typing it was 10/06/2000. Told ya I'm a bit of a thicko. Thanks for your help though. X

    One judge considered that a loan without a legally enforceable CCA is "just a gift".

    A photocopy wouldn't count then. I thought cause it was what a signed it was proof I'd applied for card. Thought PPI was maybe unenforceable but not balance. Tell me more please. What is my next step?:A
