eBay T&C's say sellers aren't expected to continue a transaction where the buyer "has not met the seller's terms" as laid out in the listing, which is the case. If the seller breaches eBay T&C's that does not necessarily have to affect the separate contract formed with the buyer and seller if the purchase has been made and money exchanged. I'd love to talk about it more, but I won't be continuing with this thread due to childish, false accusations such as ("He is the seller") & ("He is someone who does this").

This thread is deja vue, and ebay will be happy, like the other auction that was discussed in the thread already mentioned. They'll let sellers keep listing, and including P&P for as long as they can by the look of it.Auction closed, and not stopped by ebay. I find it hard not to suspect it hasn't been reported, so perhaps ebay policy isn't strictly enforced.
Or perhaps ebay know there's a 50/50 chance the buyer won't pay the extra charges added after the auction, the buyer won't agree to a mutual, and the seller will have to pay the fees, then either ship anyway, or re-list, and pay ebay a second lot of fees. So win/win for ebay all the way.0 -

So whilst, e.g. it is possible for a seller to specify they will only post an item within the UK (such term does not violate ebay policies), and so will not be expected to sell to a person who attempts to buy and request shipment overseas

a seller cannot make up terms and expect buyers to comply that do violate ebay terms & conditions.

I suppose you also think "No returns" means if Paypal tell the buyer to return something, you can tell them to stuff it? I bet you also subscribe to the whole "I get proof of posting, so if it goes missing it;s not my fault" way of thinking. :rolleyes:

The seller in this case has agreed to free p&p, and in return, they got their listing appearing very high in searches. The free p&p is what the seller has agreed to in order to have this benefit.
The spiel in their listing is to describe the item, and any mention of extra postage is irrelevant, as the postage has already been agreed earlier.
Smashed, just await delivery of your item, and if it doesn't arrive, just open a dispute. DO NOT pay any extra.Should've = Should HAVE (not 'of')

Buyer has paid the invoice amount already..seller either sends the goods or returns the money..simple. If seller admits he was wrong to try and over rule ebay t and cs and sends the item then that is the end of it, OP can leave positive feedback and it can be put down to a mis understanding.
However if seller is foolish enough to refund the money and refuse to sell then a neg and 1 * for the appropriate sections may well put him in the suspension zone..you seem very eager to get this seller suspended :eek:
Can i just point something out, a seller "over ruling" or contradicting ebay terms and conditions of selling on the site has absolutely nothing to do with us as buyers, it's a private contract between seller And ebay.
Sure you're all quick to say " sellers terms and conditions mean nowt, only ebay terms are relevant" But the sellers terms and conditions are the legal contract of sale and where the law comes into it ebay terms and conditions "mean nowt" Your quick to dismiss the legal obligations that you have when ebay t&c's suit better but want to use the law when it suits.
You want to quote the law when sellers say no returns but the distance selling regs say they have to take returns,
you want to quote the law when a seller commits fraud,
You want to quote the law when paypal wont give you your money,
you want to use the law when you get scammed.
but if you can get £3.99 off the price of something, all of a sudden you want to ignore the law......:rolleyes:

I hate this sort of thing from a selling point of view- new buyer comes along, buys one of these and gets screwed, that may put them off the whole of ebay. The quicker these dumb, scamming sellers get kicked off the better and if that means buying from them and insisting then I will. I won't go out of my way to do it, but I won't shy away from those listings if I see one. I am fed up to the back teeth of all these rule breakers- and benders that make life difficult- there are legitamate ways round those rules, like starting your price higher for crying out loud! :mad:This is my opinion. Turkish has really explained my own view on this. I use ebay to sell my goods and I threrefore need buyers, if those buyers get caught out by sellers making things up as they go along they will just decide that ebay isn't for them and walk away. That is one less buyer potentially for my goods.
I never used to bother reporting these auctions, I always assumed that people would just ignore them so I would ignore them as well. However seeing that there are people who seem to think it is acceptable to do this as a business model to get one over on ebay has made me think it is a deliberate ploy that some sellers use..so I will now report them, report them again and also report every other breach in their auctions.
