    You seem VERY presumptuous. Did it not occur to you that I searched for FREE P&P listings by default? And that it came up with "FREE P&P in his listing not once but twice? Some people might even have thought that the £3.99 part was the mistake, and that he had pasted that into his text from another listing by mistake. (I copy paste my listings headers and footers from Word, and double check to ensure I dont list the wrong description with the wrong game etc as it is easily done.

    I bend over backwards to help both sellers and buyers alike. However, I have changed my stance somewhat after seeing that he does this in a lot of listings.

    I think it also worth noting that if seller does just decide to refund and hope it all goes away then they are stuck with their FVFs of approx £2.69.

    Premier: No. eBay won't insist the seller sends the item when his terms and conditions were not fulfilled. They will instead insist he refunds the buyer, which he has offered to do.

    smashed: Of course it occurred to me that you searched for free p&p listings - you mentioned that fact enough times :rolleyes: After noticing the conflicting payment charges you should have queried it with the seller or been prepared to pay the fee. You're not prepared to pay the fee. That's fine. Take the refund the seller has offered you. You haven't managed to skip the postage fee this time. Better luck next time.

    soolin: The sellers T&C's still hold some weight even if they did not comply with eBay rules. If I put a £10,000 sound system for sale for a 1p buy it now, but in the auction description and against eBay rules stated that the buyer would have to pay another £9,999 to receive it, that term does not get nullified just because it's against eBay rules and the buyer is not entitled to the sound system for 1p.

    Similar to here, the seller broke the rules, but is not necessarily entitled to the item without paying the extra fee mentioned in the dsecription.
  • Someone else is clearly clueless regarding the rules about free postage listings and sellers T&Cs over riding ebays.

    Prehaps it's because they also attempt add P&P themselves into free categories?

    I didn't say they would.
    I said ebay would back the buyer that they need pay no extra charge for delivery.
    I also said if the seller fails to deliver, then the buyer should raise a non performing seller claim

    If a non performing seller claim is successful, the seller will receive a strike sending the seller closer to looking for a new trading platform in future.
