pendulum: If the seller has already put in "FREE P+P" it means he is agreeing with eBay's T+C's on items with no P+P.
He cannot them go in later to the item listing and add that there is a P+P charge. Exactly, if it is the case that sellers can list items in the categories for free p&p and then state p&p charges in their T&C's and this can then be upheld then what is the point in the free p&p categories at all?, they should either put the p&p they want to charge onto their starting bid or BIN price or HAVE to sell the item with free p&p irrespective of what tripe they put in their T&C's, otherwise suffer the consequences of negative feedback, Non performing seller charge and low DSR'sAug GC £63.23/£200, Total Savings £00

Not unless you put it as a postage price. Ebay rules override all conflicting seller terms, that is just the way it is. Also I think the rule about fee avoidance would apply :rolleyes:soolin: The sellers T&C's still hold some weight even if they did not comply with eBay rules. If I put a £10,000 sound system for sale for a 1p buy it now, but in the auction description and against eBay rules stated that the buyer would have to pay another £9,999 to receive it, that term does not get nullified just because it's against eBay rules and the buyer is not entitled to the sound system for 1p.This is my opinion. I think Pendulum is the seller. He/she seems very upset about the whole thing and is making up lots of excuses for this seller, despite every other poster saying the seller is in the wrong.0

Similar to here, the seller broke the rules, but is not necessarily entitled to the item without paying the extra fee mentioned in the dsecription.
I agree that the seller cannot be forced to send the item in question, that is not the point that is being argued. Your example quoted above though shows you have a serious misunderstanding of how ebay works, there is a difference between not being able to force a seller to sell and a seller being suspended from ebay for being in breach of too many rules. The Buyer is almost certainly not going to get their item here, but they do get a full refund so loses absolutely nothing at all. The seller on the other hand pays listing fees, pays FVFs, gets a non performing seller strike, a neg and low stars and is possibly suspended. This whole argument is academic anyway if you wish to sell on ebay you need to stick to the T&Cs otherwise you will find yourself very quickly as a NPS with no customers and DSRs that will seriously effect any selling. So they are killing there own business oppotunities.0 -

The odd thing is I used to just ignore auctions where sellers blatantly tried to break the rules, I honestly thought there was no point in doing anything as they were effectively throwing their money away by losing a lot of buyers. You read the auction description and learned of the extra postage charge, knew postage wasn't included in the item price, but then decided to buy the item anyway, hoping to get away without paying postage. You've wasted his time as well as your own. You'll just get a refund and nothing for your troubles. What a waste of time.
how did he waste the sellers time the seller is trying to rip people off why should you have to look on the t&c for postage costs :rolleyes:0 -
eBay T&C's say sellers aren't expected to continue a transaction where the buyer "has not met the seller's terms" as laid out in the listing, which is the case. If the seller breaches eBay T&C's that does not necessarily have to affect the separate contract formed with the buyer and seller if the purchase has been made and money exchanged. I'd love to talk about it more, but I won't be continuing with this thread due to childish, false accusations such as ("He is the seller") & ("He is someone who does this").0
