I think it's a complete and utter waste of time, effort and electrons.

You did ask.

You were lucky that your post was spotted on the end of such an old thread.

If it made you feel better, then that's good. I suspect that it isn't the first letter or e-mail they've had like this, though.

A better idea would be a "Letter Before Action" to the car park owner (CPO) advising them of the above, that they are "jointly and severally liable" for the actions of their agents, the PPC, and that any further actions by them would be regarded as harassment under the terms of The Protection from Harassment Act 1997. That ought to make the CPO call off the PPC and, hopefully, realise the potential cost of doing business with them.

You do need to send a copy to the PPC as well.
The acquisition of wealth is no longer the driving force in my life. :)
• I have just sent the below to CP Plus Limited. I used ReadNotify. I will let all know how it goes.
THIS E.MAIL DOES NOT CONSTITUTE AN 'APPEAL'

To whom it may concern,

I received notification of a parking charge CP Plus Limited believes it can charge me for the parking of my vehicle in the car park at MOTO Services, XXXXXXXX on XX XXX XXXX.

Firstly the ‘charge notice’ (so-called) is clearly nothing but an attempt to frighten the recipient into paying CP Plus Limited’s invalid charges. The so-called ‘notice’ is not legally binding as no contract agreed or implied has been entered into as I cannot confirm that I was the driver of the vehicle at that time.

I draw the attention of CP Plus Limited to the following online article and believe that as CP Plus Limited is a private company and is not associated with the local council or police authority, its charge is invalid.

(link not allowed by MSE as I am a newly-registered User)

I have not and will never enter in to any contract agreed or implied with CP Plus Limited nor have I broken any law or statute. I have returned the notice clearly marked ‘No Contract - Return To Sender’ as I have no wish to enter into a contract with CP Plus Limited.

Further action on my part in this matter will incur charges which will be chargeable to CP Plus Limited.

My charges will be invoiced at the following rates...

Initial Charge of £250 then £100 each time I have to respond in relation to this matter. All legal expenses and costs will be charged in addition to the above charges. Pursuing this matter will trigger these charges and by doing so, CP Plus Limited agrees to the above terms.

I look forward to a response from CP Plus Limited within 7 days.

Yours,

XXXXXX

I'll let you know how it goes:

Your appeal has been rejected. We still require payment of the parking charge issued against your vehicle.

Ways to pay:

Yada yada yada...

Well...thanks for your objective and friendly responses! What does the icon under my User Name state? Read it.

Don't be so quick to judge. Neither of you know it all.

This guy did the same recently and his notice was withdrawn: (link not allowed, so go to the Truth Hunters website and search for 'parking fines' to watch the video)

By the way, it wasn't an 'appeal'. Stated that in the e.mail header and footer.

Sorry, I wasn't having a go at you, rather that the majority of PPCs treat any correspondence as an appeal, regardless of what you put on there.

I hope they cancel it for you, but if they do then you will be in the minority.

In our experience, corresponding with PPCs only marks you out for additional harassment as they get the (misplaced) notion that you are somehow taking them seriously. That's why our advice is always to ignore (in most circumstances).

Sorry.

I think it's cool that people are taking this company on. Having said that though, my case is the only one on this forum so far where i have actually done nothing wrong, no offence. *rubbish pun not intended*. I actually bougt the ticket, was within the time limit, no obstruction caused yadder yadder yadder.....
I was sent one of the tickets from the automatic camera numberplate majiggies, but thankfully found my reciept screwed up under my seat in my van.
My theory is that they removed the payment from their system and hoped that after 10 days i would have lost my reciept so that i couldn't prove that i had paid it. (thankfully i am not too tidy)
If they "accidently" do this to maybe 1 in every 10 motorists, how much would this boost their prophits?
I just can't see how else i could have a parking ticket and a parking reciept literally stapled togethor with the same time, date and place on both of them.
Something is deffinately not right.
That is why i wrote my rude email to this lovely company

You're not 'taking this company on' you're wasting your time, effort and electrons.

Would you email the Nigeria money scammers back????? No?? Why not, they have the same intention as the PPC's??
